Clarence Thomas says Supreme Court could be "most dangerous" branch

Justice Clarence Thomas on Thursday, during rare public remarks at the University of Notre Dame, warned against politicizing the Supreme Court.
Driving the news: Thomas, the court's longest-serving member, said that the justices do not rule based on "personal preferences" and that politicians should not "allow others to manipulate our institutions when we dont get the outcome that we like," per the Washington Post.
Thomas, 73, also criticized some of his colleagues, without naming names, for veering into the role of politicians, saying that "[w]hen we begin to venture into the legislative or executive branch lanes, those of us, particularly in the federal judiciary with lifetime appointments, are asking for trouble."
"The court was thought to be the least dangerous branch and we may have become the most dangerous," he added. What he's saying: "It is not about winning or losing at the court, it is about the entire country and the idea of this country," Thomas said.
"I think we should be careful destroying our institutions because they don't give us what we want, when we want it."

There Thomas rejects stare decisis for both constitutional and statutory cases except in cases where the precedent is not demonstrably erroneous.

A judge that goes into every case with a pre-determined outcome is no judge at all.

(1,666 posts)If the court case is gun related, the only vote you might, maybe need to guess on would be Roberts. If the case is about expanding gun laws in a way the right likes or striking them down, 3 votes will be no and 5 will be yes.
This is why we go through the theater of the nomination process, because both sides want to make sure their pick will vote their goals. If we didnt care, we would not grill them in such a way that forces them to clam up. If we didnt care how they would vote, we would not be asking them questions like what do you think of this or that law or if this came before you, how would you vote.
The entire nomination process is enough proof that accusations of you just want a judge to vote how you want, applies to everyone.

Too late. The court is already fully politicized. Maybe he should warn against perverting the Supreme Court. You know, warn against having judges on the court who sexually abuse women or who belong to weird religious cults.
We have every shade of ultra right wing GOPers on the court and now he warns against politicizing?
He"s afraid additional members to the court will break the GOP strangle hold on the court.

On Wednesday morning, Ginni Thomaswife of Supreme Court Justice Clarence Thomasendorsed the rally in Washington demanding that Congress overturn the election. She then sent her LOVE to the demonstrators, who violently overtook the Capitol several hours later. Two days later, Thomas amended her post with the addendum: [Note: written before violence in US Capitol]. By that point, five people involved in the insurrection, including a Capitol Police officer, had died.
Thomas, a conservative lobbyist and zealous supporter of Donald Trump, has fervently defended the president over the last four years. On her Facebook page, she frequently promotes baseless conspiracy theories about a coup against Trump led by Jewish philanthropist George Soros, a frequent target of anti-Semitic hate. Thomas draws many of these theories from fringe corners of the internet, including an anti-vax Facebook group that claimed Bill Gates would use the COVID vaccine to kill people. In recent months, she also amplified unsubstantiated corruption claims against Joe Biden while insisting, falsely, that the Obama administration illegally spied on Trumps 2016 campaign, then tried to rig the election against him.
In turn, Trump has rewarded Thomas with an extraordinary amount of access to the Oval Office. Her advocacy group Groundswell got an audience with the president in early 2019. According to the New York Times, the meeting was arranged after Clarence and Ginni Thomas had dinner with the Trumps. (Clarence Thomas and Trump appear to be quite friendly: The justice took his clerks to meet with the president in the Oval Office at least once; Ginni attended as well.) At the White House, Groundswells members lobbied Trump against transgender service in the military, which he already prohibited in 2017. The ban took effect in 2019, around the time of Groundswells meeting, after the Supreme Court lifted lower court orders blocking it by a 54 vote. (Clarence Thomas did not recuse himself from the case; he has never recused from any case because of his wifes lobbying activities.) The New York Times also reported that Ginni Thomas compiled lists of federal employees whom she deemed insufficiently loyal to the president. She sent her lists to Trump, urging him to fire the disloyal employees, though he seems to have largely ignored her. He has, however, stacked his administration with former Thomas clerks.

And the GQP's assertion that Scalia's replacement had to have a similar judicial temperament, when TFG shoved RW ideologue ACB into RBG's seat when she died? Nothing about politicizing the Court when that happened, right?
