Clarence Thomas says Supreme Court could be "most dangerous" branch

Source: Axios

Justice Clarence Thomas on Thursday, during rare public remarks at the University of Notre Dame, warned against politicizing the Supreme Court.

Driving the news: Thomas, the court's longest-serving member, said that the justices do not rule based on "personal preferences" and that politicians should not "allow others to manipulate our institutions when we don’t get the outcome that we like," per the Washington Post.

Thomas, 73, also criticized some of his colleagues, without naming names, for veering into the role of politicians, saying that "[w]hen we begin to venture into the legislative or executive branch lanes, those of us, particularly in the federal judiciary with lifetime appointments, are asking for trouble."

"The court was thought to be the least dangerous branch and we may have become the most dangerous," he added. What he's saying: "It is not about winning or losing at the court, it is about the entire country and the idea of this country," Thomas said.

"I think we should be careful destroying our institutions because they don't give us what we want, when we want it."

9. The very idea of clarence, who admittedly votes his 'feelings' and is not concerned

with precedent, doing such public pronouncements.

'Why Justice Thomas Is Wrong about Precedent

This term Justice Clarence Thomas wrote an important concurring opinion on stare decisis in Gamble v. United States, the case on the scope of double jeopardy. There Thomas rejects stare decisis for both constitutional and statutory cases except in cases where the precedent is not “demonstrably erroneous.”

[not ''demonstrably erroneus'' - Wow. ]

11. You can predict with uncanny accuracy what Thomas' ruling will be before any evidence is heard.

That is because his rulings are based on his "personal preferences" and political leaning.

A judge that goes into every case with a pre-determined outcome is no judge at all.

How much money has the Thomas family made from Right Wing organizations?

16. You can do that with all the justices on party issues.

If the court case is gun related, the only vote you might, maybe need to guess on would be Roberts. If the case is about expanding gun laws in a way the right likes or striking them down, 3 votes will be no and 5 will be yes.

This is why we go through the theater of the nomination process, because both sides want to make sure their pick will vote their goals. If we didn’t care, we would not grill them in such a way that forces them to clam up. If we didn’t care how they would vote, we would not be asking them questions like “what do you think of this or that law” or “if this came before you, how would you vote”.

The entire nomination process is enough proof that accusations of “you just want a judge to vote how you want”, applies to everyone.

He warned against politicizing the Supreme Court??????

Too late. The court is already fully politicized. Maybe he should warn against perverting the Supreme Court. You know, warn against having judges on the court who sexually abuse women or who belong to weird religious cults.

We have every shade of ultra right wing GOPers on the court and now he warns against politicizing?

He"s afraid additional members to the court will break the GOP strangle hold on the court.

Ginni Thomas apologizes to husband’s Supreme Court clerks after Capitol riot fallout

Robert Barnes

https://www.washingtonpost.com/politics/courts_law/ginni-thomas-apology-clarence-thomas-clerks-trump-rally/2021/02/02/a9818cce-6496-11eb
Conservative political activist Virginia Thomas told her husband Justice Clarence Thomas’s former law clerks that she was sorry for a rift that developed among them after her election advocacy of President Donald Trump and endorsement of the Jan. 6 rally in D.C. that resulted in violence and death at the Capitol
=============================

Thomas has made clear her opposition to the Affordable Care Act, for instance, and other initiatives of the Obama administration. This summer, she tried to get the small Virginia town of Clifton to take down a Black Lives Matter banner. “Let’s not be tricked into joining cause with radical extremists seeking to foment a cultural revolution because they hate America,” she wrote to town leaders.

She has been a delegate to the Republican National Convention. And after first endorsing Sen. Ted Cruz (R-Tex.) for president, she became an ardent Trump supporter, meeting with the president at the White House to advise on political appointees. When Trump gathered supporters at the White House to celebrate his acquittal at his first Senate impeachment trial, she was among those invited.

Ginni Thomas, Wife of Clarence, Cheered On the Rally That Turned Into the Capitol Riot
“GOD BLESS EACH OF YOU STANDING UP or PRAYING!”
BY MARK JOSEPH STERN
JAN 08, 202112:17 PM
https://slate.com/news-and-politics/2021/01/ginni-thomas-donald-trump-clarence-thomas-capitol-riot.html
On Wednesday morning, Ginni Thomas—wife of Supreme Court Justice Clarence Thomas—endorsed the rally in Washington demanding that Congress overturn the election. She then sent her “LOVE” to the demonstrators, who violently overtook the Capitol several hours later. Two days later, Thomas amended her post with the addendum: “[Note: written before violence in US Capitol].” By that point, five people involved in the insurrection, including a Capitol Police officer, had died.

Thomas, a conservative lobbyist and zealous supporter of Donald Trump, has fervently defended the president over the last four years. On her Facebook page, she frequently promotes baseless conspiracy theories about a “coup” against Trump led by Jewish philanthropist George Soros, a frequent target of anti-Semitic hate. Thomas draws many of these theories from fringe corners of the internet, including an anti-vax Facebook group that claimed Bill Gates would use the COVID vaccine to kill people. In recent months, she also amplified unsubstantiated corruption claims against Joe Biden while insisting, falsely, that the Obama administration illegally spied on Trump’s 2016 campaign, then tried to rig the election against him.

In turn, Trump has rewarded Thomas with an extraordinary amount of access to the Oval Office. Her advocacy group Groundswell got an audience with the president in early 2019. According to the New York Times, the meeting was arranged after Clarence and Ginni Thomas had dinner with the Trumps. (Clarence Thomas and Trump appear to be quite friendly: The justice took his clerks to meet with the president in the Oval Office at least once; Ginni attended as well.) At the White House, Groundswell’s members lobbied Trump against transgender service in the military, which he already prohibited in 2017. The ban took effect in 2019, around the time of Groundswell’s meeting, after the Supreme Court lifted lower court orders blocking it by a 5–4 vote. (Clarence Thomas did not recuse himself from the case; he has never recused from any case because of his wife’s lobbying activities.) The New York Times also reported that Ginni Thomas compiled lists of federal employees whom she deemed insufficiently loyal to the president. She sent her lists to Trump, urging him to fire the disloyal employees, though he seems to have largely ignored her. He has, however, stacked his administration with former Thomas clerks.

What does he say about Moscow Mitch keeping Scalia's seat empty for a year, denying Obama his constitutional right to appoint a successor? And the GQP's assertion that Scalia's replacement had to have a similar judicial temperament, when TFG shoved RW ideologue ACB into RBG's seat when she died? Nothing about politicizing the Court when that happened, right?
