Biden declines Trump request to withhold White House records from Jan. 6 committee
Source: NBC News
WASHINGTON The White House on Friday formally blocked an attempt by former President Donald Trump to withhold documents from Congress related to the Jan. 6 attack on the Capitol, setting up a legal showdown between the current and former presidents over executive privilege.
In a letter to the National Archives obtained by NBC News, White House Counsel Dana Remus rejected an attempt by Trumps attorneys to withhold documents requested by the House Select Committee regarding the then-presidents activities on Jan. 6, writing that President Biden has determined that an assertion of executive privilege is not in the best interests of the United States, and therefore is not justified as to any of the documents.
These are unique and extraordinary circumstances, Remus added. Congress is examining an assault on our Constitution and democratic institutions provoked and fanned by those sworn to protect them, and the conduct under investigation extends far beyond typical deliberations concerning the proper discharge of the Presidents constitutional responsibilities. The constitutional protections of executive privilege should not be used to shield, from Congress or the public, information that reflects a clear and apparent effort to subvert the Constitution itself.

It wouldn't surprise me if they're already written, just waiting for the blessed day of his demise. They're certainly not a sentimental lot, and money is their driving force.

(15,310 posts)These documents need to be released NOW!!!
There is no legal basis to allow Donnie Dipshit to try to play his tired and corrupt "run out the clock" bullshit.
Give these documents to the committee now and let Donnie Shit for Brains try to sue.
We simply can't wait for two years while the courts dick around on something THAT HAS NO BASIS IN ESTABLISHED LAW

Release the documents now to the Committee and then let TFG's retroactively try to stop the process.

(42,660 posts)And it can then go to the courts, although greater weight should be given to Biden's position.
As for why they can't be released immediately? Because the documents are in the possession of the National Archives and the process by which the Archivist of the United States releases presidential records is governed by a statutory scheme that establishes a particular timeline, including notice requirements.

TFG evidently thinks executive privilege exists for the express purpose of shielding whatever information he wants to shield from whoever and for whatever reasons he wishes to shield it. I have a feeling he's about to find out just how wrong he is.

This is a gut shot to TFG and Joe and his people know that TFG and his lawyers have little chance @ arguing that TFG's claim of executive privilege is not only moot because he is no longer an executive but protection of the Constitution and America's democracy supercede TFG's claim of
