GOP attempt to award Mich. Electoral College votes to Trump referred to feds, Nessel says

Attorney General Dana Nessel said in a television interview Thursday her office has referred the submission of a false slate of presidential electors from Michigan Republicans for the 2020 presidential election to federal prosecutors.

Nessel made the comments Thursday during an interview with MSBNC’s Rachel Maddow.

As Michigan’s presidential electors convened on Dec. 14, 2020, to cast their votes for Joe Biden, a group of Republicans signed on to their own certificate that attempted to award the state’s 16 Electoral College votes to Donald Trump.

The document, shared with the U.S. House committee investigating the deadly Jan. 6 assault on the U.S. Capitol last year, was obtained by POLITICO.

Law enforcement denied access to the group of Republicans who tried to deliver their own electoral votes to the Capitol in Lansing that day, incorrectly arguing they were the state's presidential electors. ...........................

And should have been known to the notary as being false. Could the notary be prosecuted for notarizing a false document?

that the signatures are valid and of the person signing.

That's all. A notary can be liable if the signature did not happen in their presence or if they did not properly identify the person signing.

They are not liable for anything in the document, beyond signatures.

A couple of days ago, someone posted a link to a PDF of all the electoral vote and replacement-elector certificates. To me they look like the same Word templates were used for all of them.

My bet is someone in Trump’s inner circle built these two documents and shipped them via email. We know it wasn’t Trump because Trump can’t run a computer; he has people around him who can, and it would take just a few minutes to type these up.

One thing that gives them away: A real one lists every candidate on the ballot including the write-ins and documents the number of votes each received…so if one person wrote in Snoop Dogg and one person wrote in Pete Carroll, head coach of the Seahawks, the certificate of ascertainment would read, “Calvin Cordozar Broadus Jr, no electors recorded, one vote; Peter Clay Carroll, no electors recorded, one vote.” The phony ones just state, “Winner of the election, Donald Trump.” And yes, Snoop Dogg is constitutionally eligible to be president; he’s 41 years old, was born in California and has lived here his whole life. (One must admit, he would have been a better president than Trump - not a difficult task, but still.)

Trump referenced it in a legal filing.

And copies of the fake certificates have been available to the public since March thanks to a FoiA request.

Worse, this is only 1 of 7 states. What's going on in the others? GQP AGs?

and he has only been in office not even a year (won't be until January 20 of THIS year).

During that time, he has had to get NEW US Attorneys nominated to replace the TFG ones (still ongoing) so that they can try to proceed with getting the insurrection shenanigans worked on because you know those previous hand-picked ones were going to slow-walk it in each of their jurisdictions.

There are still some "actings" in there and others who are still in the positions (there are 94 total US Attorneys) pending confirmations of replacements. So far per this list - https://www.justice.gov/usao/us-attorneys-listing there are 32 Biden appointees who are operational.

And that list NOW includes the most important one of all with respect to the insurrection - the US Attorney for the District of Columbia, who JUST got confirmed October 28, 2021 and sworn in on November 5, 2021 - https://www.justice.gov/usao-dc/meet-us-attorney

(in the federal government, those sorts of "acting" details are generally time-limited)

In the "good old days", unless you had a controversial nominee, these types of positions were confirmed "by unanimous consent" in the Senate. But the current GOP has stopped that process and has insisted on objecting to unanimous consents for many nominees - which then slows the process, requiring scheduling of a debate a vote of the full Senate.

Since 2002, Ison has served as an Assistant United States Attorney for the Eastern District of Michigan, where she has prosecuted drug trafficking offenses at the highest level in the Office’s Drug Task Force Unit. She also served as Chief of that unit, which is the largest unit in the U.S. Attorney’s Office. Since 2014, Ison has served as the Office’s District Election Officer, and also represented the Office in the federal court’s alternative to prison program. Early in her career, Ison spent twelve years as a criminal defense attorney.

Over the course of her career, Ison has successfully handled large-scale, complex, multi-defendant prosecutions. Before then, there was an "acting" US Attorney for that jurisdiction. The MI AG is a Democrat (in the position since 2019).

This is why the "delay". You don't want to hand off something as legally catastrophic as this to an "acting".

Saw her on Rachel talking about, her office had been investigating this since it happened over a year ago; I think they should have incited and charged the persons who signed this fraudulent document. Kicking it over to the DOJ just delays any action for another year.

they shared all their evidence with a MI district USA. Both entities, state and federal, can still bring charges and likely will. What happened, at least to the best of my ability to read into this, is the state officials reached a point where the Michigan investigation led to crimes outside the state's jusrisdiction. Also, there may have been substantial contacts between the entities, but this just became known to us recently.

Well, the referral just became known to us, we watched the fake elector drama in real time as the criminals were filming themselves.

I say that because I believe these are ordinary people caught up in the fervor stirred by a wolf in a red cap who promises glory to the patriots. They figured if they could pull this off it would counter all the leftist cheating that threatened to burst their bubble of sanctuary.

They knew with Trump safely retained in the Oval Office it would all be swept under the rug as the work of loyal citizens. I say make an example of them in case someone thinks it'll work next time.
