Kyle Rittenhouse named in civil suit filed by parents of man killed in Kenosha

Kyle Rittenhouse has been added as a defendant to a civil lawsuit filed by the parents of Anthony Huber, a Wisconsin man Rittenhouse fatally shot in Kenosha during street protests in August 2020.
In a criminal trial last November, Rittenhouse was found not guilty of five charges related to killing Huber and Joseph Rosenbaum and injuring Gaige Grosskreutz with an AR-15-style rifle. A civil trial could replay evidence against the 18-year-old before a jury, in addition to statements he has made in right-wing media since going free. The suit does not specify any monetary damages, but attorneys for the parents filed a $10 million claim notice in December.

He became an active shooter and my son tried to stop him," John Huber said. Unfortunately, he wasnt able to stop him, and he lost his life in the process.
Hubers parents filed the original lawsuit against the city of Kenosha and the Kenosha Police Department last August. The updated motion adds Rittenhouse and seven law enforcement agencies and counties from the area as defendants.

They can (and do) say that he was trying to protect others. But it's unlikely to go anywhere. They may have some success with a gofundme "justice for Anthony" campaign.

(53,741 posts)Seems like a strong civil case to me where the verdict doesn't have to be unanimous. They should also add the guy who bought and supplied the assault weapon to a teenager.

(6,799 posts)Amid the plentiful examples of weird justice in this age of intellectual perversion, "Stand Your Ground" is a principle which needs to be shown the door. This provides an instance wherein there are enough POV's before the eyes of justice to clearly expose how this barely visible legal principle is finally revealed to have no opaque qualities whatsoever.
I mean, how does one defend the action required to "stand another's ground"? By getting killed while performing a public service.
The case may go nowhere on its merits but all the amateur bone surgeons watching from home on their Tee-Vees would see how the x-rays clearly show the broken cranium.

(7,402 posts)Huber just witnessed Rittenhouse gun down another person. He tried to neutralize an active shooter with nothing but a skateboard. If I was in that same situation, I would like to think I would have acted in a similar manner to Huber, especially the grabbing for the gun. What I not seeing?

(26,721 posts)If Huber had survived and for some reason was charged with assault... he would absolutely have had a self-defense case and/or been able to claim that he was trying to protect others. The reasonableness of his assumption that Rittenhouse was an active shooter would have been almost impossible to beat. "The law" would have been on his side - just as it was on Rittenhouse's side in defending against criminal charges.

(22,462 posts)If Huber had a gun and killed Rittenhouse it would be justified because Rittenhouse was an immediate danger. But all Huber had was a skateboard so Rittenhouse wins? Remember Rittenhouse was pointing his gun at at least one of those men.

that confrontation involves a good guy and a bad guy and the law should punish the bad guy. The law doesnt work that way.
It all depends on being a criminal defendant. Yes
if Huber had a gun and had shot Rittenhouse
he would have no trouble convincing a jury that it was in self defense.
Its entirely possible for two people to each legitimately believe that their lives are in danger and use deadly force. Thats probably why it isnt a good idea to bring a firearm to a protest where tempers are likely to flare.
Having just a skateboard doesnt change anything. Huber would be protected if someone were charging him for the assault
but its an entirely different case if hes trying to sue someone else. The law protects defendants - not good guys

If he had been spraying bullets as he ran down the street
then it could still be defense of others (though probably not self defense), but that wasnt what was caught on film.
Neither of which matters much - because legitimate self defense does not demonstrate that you were illegally assaulted - but it is a defense against such a claim.

(1,510 posts)While a criminal trial requires a UNANIMOUS jury verdict, civil matters require only a MAJORITY of the jury -- 12 people on the jury, if 7 vote GUILTY, then, the family wins a bundle of $$$$$.

The only requirement to a seat in congress is an assault rifle, or many. Killing a few libs makes you a shoe in. Congressman Kyle. Get ready for it. I'm seeing wage garnishment in his long-term future! Huber's parents are in the process of attaching to his future earnings. I'm sure they would much rather have Anthony back, for sure, but a Rittenhouse pension may help assuage their grief, or at least address any financial hardship they endured over this.

Fake crying in movies has always bugged me - they scrunch up their face and make sobbing sounds without any trace of real tears. A good actor can draw upon past experience and get themselves to really cry. In leiu of that youd think the special effects department could come up with something to make the scene more believable.

Huber/Rosenbaum should've 'self-defensed' him, but I doubt they (being viewed as being on the side of BLM) would've received the same 'kid glove' treatment that Shittenhouse did (who the cops enabled). The majority of White America dislikes BLM and views the punk as a hero - that's the problem with getting justice in cases like these.
However, BLM and a tougher Left in American politics is the future - even young whites tend to side with BLM.
