Adult who, at 17, sexually assaulted child is sentenced to juvenile facility

The case of Hannah Tubbs, who has admitted sexually assaulting a 10-year-old girl in 2014 in the bathroom of a Denny's restaurant in Palmdale, has thrown a spotlight on Los Angeles County Dist. Atty. George Gascn's refusal to seek the transfer of juvenile defendants to adult court. Gascn has argued that the brains of juveniles aren't fully developed and that the proper setting to rehabilitate people who commit crimes while underage is a juvenile treatment facility.

How does that make sense... minors are separated from the adult population and often housed at entirely different facilities than adults specifically to ensure they are not put into the population with adults. I believe this is even done with minors who are charged and convicted as adults (but could be wrong on that one--edit to clarify: They're incarcerated within adult jails/prisons, but separated from interaction with general population). She should be placed with the adults in adult jail.
7 years after the crime, the victim is still in therapy and did not attend the case, the rapist piece of shit gets 2 years. 2 years for ruining someone's life is a joke.

(724 posts)The DA needs to be recalled. It is amazing how little justice means to some men when a woman is the victim. Hannah is an adult - Hannah should go to an adult prison. And if Hannah is male-bodied, Hannah needs to go to a men's prison. A women's prison doesn't need a sexual assaulter amongst a vulnerable female population - most of whom are in prison for non-violent crimes.

Going to go with the expert, and her considered and reflected upon legal decision not to seek transfer in an opposed hearing before a real judge, which is not automatic as there is a considerable burden
will eschew the Twitter verdict. Sue me.

(24,145 posts)Many years ago, I had gone out for a quick run, and was attacked by a guy with a stocking over his head, and a very large knife. I got away from him. He ended up being charged with attempted kidnapping, attempted rape, and attempted murder. He had tried this with several other women in the area. He was 17 and a half years old. His attorney dragged his young wife and baby into court, and they wailed through the entire sentencing. He went to Juvie Jail. There for 6 months until he turned 18, then let out, and his record expunged.
That case, nor the guy in the story, got the justice they deserved. And I don't see much chance of rehab. Sorry.

According to Superior Court Judge Mario Barrera, who presided over the hearing, prosecutors with Gascóns office never filed a motion to transfer Tubbs case to an adult court, where she would have faced a longer prison sentence in an adult facility.
I want to be clear, Barrera said Thursday during Tubbs custody hearing. The filing of a transfer motion is entirely within the discretion of the district attorney
Following Thursdays hearing, Deputy District Attorney Shea Sanna, who had backed a request to house Tubbs in a county jail for adults, said he had wanted her placed in an adult facility so she would not be around impressionable children, the LA Times reported.
You have a violent child sexual predator whos been sentenced to two years in a juvenile facility, he said. As a prosecutor, he added, Im not here to protect child molesters.

All this time I thought the D.A.'s office was supposed to advocate for the victim not the child molester.
