Biden wants new protections for trans students, sexual assault survivors

On the 50th anniversary of Title IX, the Biden administration proposed sweeping changes to the landmark law that would bar schools, colleges and universities from discriminating against transgender students, a move that comes as the battle over transgender rights moves to the front lines of the culture war. The proposal would extend the protections of Title IX, which prohibits schools that get federal funds from discriminating on the basis of sex, to transgender students, compelling schools to accommodate and protect them.

This includes permitting them to use bathrooms that align with their gender identity, using their correct pronouns and addressing bullying based on their gender identity. It would also amend the rules that govern how schools, colleges and universities investigate and resolve claims of sexual assault and sexual harassment. Over concerns that people were being wrongfully punished, President Donald Trump’s education secretary, Betsy DeVos, revised the rules to make them more accommodating to the accused.

Critics assailed the changes, saying they would discourage sexual assault survivors from coming forward to report assaults or harassment. As a candidate for president, President Biden promised to put a “quick end” to the DeVos regulation if elected, saying it gave colleges “a green light to ignore sexual violence and strip survivors of their rights.” But the administration sidestepped one of the most heated debates, saying the rules would not deal with whether transgender students should be permitted to participate in sports. That fight would be saved for another rulemaking process, the Education Department said.

Thursday’s announcement was a notice of proposed rulemaking, the starting point of a lengthy process to create new guidelines on how the Education Department interprets and enforces Title IX. They do not require sign-off from Congress. In a news release, the department said that “the Department’s proposed amendments will restore vital protections for students in our nation’s schools which were eroded by controversial regulations implemented during the previous Administration.”

10. Been lurking. Hearing so much unwarrented criticism of the President and just ...

... general pessimism about when 45 is going to get his. It just got to me. I didn't want to argue with friends or get too many alerts - so I just started reading and following threads.

I never stopped looking in the usual places for infiltrators.

I've gotten my right eye done (cataract) and my left one will be done at the end of July.

Almost feeling 35 again.

6. These are the actions of a true leader and a truly amazing person

I've said it before, I'll say it again, I'll say it many times in the years to come: I am beyond grateful and proud to have Joe Biden as our president, especially during these frightening and ugly times. His compassion, his strength and his willingness to fight for human rights and the vulnerable is incredible.

This is what a leader does. Leads with compassion and strength, not cruelty and fear. A true leader uses their position and power to protect those in need of protection. A true leader uses their position to lift all people up.

It's long overdue for Title IX to actively and openly protect trans people as well. Obviously, this one matters to me, and I'm absolutely thankful to know that our president wants those same protections to apply to us, and that people like me are treated as women as well.

Rolling back the damage that Cruella DeVos did, and doing more to protect victims of sexual assault... That's just as important. No question about it. Women should be safe from sexual assault in the first place. In a perfect world, no one would ever be sexually assaulted. Sadly, we don't live in such a world. So what we can do here, today, is make it easier for victims to come forward, and to do more to protect women to speak up and report abuse.

Once again, I can only stand and applaud this great man as he works to help, protect and improve life for all of us. Thank you, Joe Biden.

“Our goal is to give full effect to the law’s reach and to deliver on its promise to protect all students from sex-based harassment and discrimination,” Education Secretary Miguel Cardona said. “Every student deserves to learn free from discrimination and harassment, regardless of their sex, sexual orientation or gender identity.”......

Now the Biden administration wants to use it to cement protections for transgender students. If the proposal is realized, it would compel schools to accommodate transgender students by allowing them to use bathrooms that align with their gender identity, ban bullying based on their gender identity and ensure they are addressed by their correct pronouns. Schools that do not rectify the problem are subject to investigations and risk losing their federal funding.

The moves come as conservatives across the country fight to exclude transgender students from sports, outlaw gender-affirming medical treatments and purge libraries of books with LGBTQ characters. As of March, state legislators had filed more than 200 bills seeking to erode the rights of transgender students or restrict discussion about LGTBQ issues in classes.

Conservatives reject this interpretation, saying discrimination against transgender students is not a violation of Title IX and have argued in lawsuits that certain accommodations — like permitting transgender students to use bathrooms that align with their gender identity — violate the privacy of their cisgender classmates.


Texas and other states are targeting trans youths, their parents and medical professionals for providing needed gender affirming treatment to trans youth. These new regulations when adopted will help protect these youths.
