Judge strikes down 1931 Michigan law criminalizing abortion

A judge on Wednesday struck down Michigan’s 1931 anti-abortion law, months after suspending it, the latest development over abortion rights in a state where the issue is being argued in courtrooms and, possibly, at the ballot box.

The law, which was long dormant before the U.S. Supreme Court overturned Roe v. Wade in June, violates the Michigan Constitution, said Judge Elizabeth Gleicher.

“A law denying safe, routine medical care not only denies women of their ability to control their bodies and their lives — it denies them of their dignity,” Gleicher of the Court of Claims wrote. “Michigan’s Constitution forbids this violation of due process.”

The decision comes as the Michigan Supreme Court still is considering whether to place a proposed amendment on the Nov. 8 ballot that would add abortion rights to the state constitution. A Friday deadline is looming.

for a living, breathing woman to have fewer rights than a corpse.

I'm glad I live in New Mexico, the lege got the vestigial antiabortion law off the books in 2021.

It is equality. Women, whether married, single, working for their family or a business, make responsibility decisions every day. We buy and prepare food for our families. We decide what school to enroll our kids in. We nurse family members when they are sick and assess when they need to see a dr. We help pick out a house and help pay for it. We keep it clean. In an ideal world, married partners share the decisions and the labor. Most men rely on the 'little lady' to pull her weight in all areas of their shared life. Many women pull more than their fair share.

The only people who assume women can do a large share of the work, but can't decide on her own what her medical care should be, are people who want to trap women to use and abuse them and certainly want to avoid respecting an adult human being.

Our State Supreme Court has to rule by Friday this week to direct the reproductive rights amendment to our state constitution to appear on the November ballot. THAT is the real solution here, which needs to happen, to reset the laws in Michigan now that Roe is gone.

And so do Republicans who are already running ads against the amendment. The ad they're running is hilariously ineffective and its theme is that we'll be adding "60 errors to our Constitution". LOL, they aren't errors at all, the spacing is there, it's just slightly less space than normal due to the print job, it's easy to understand and read.

I guess they really meant, "only if said states agree to make abortion illegal; otherwise, send it back to us."

But wouldn't that be really hypocriti... Oh, wait. I forgot who we were talking about for a moment there!

When they say 'states rights' - they mean 'if the state leans right'.

Otherwise - 'We are thine medieval lords and masters, heathens!'

Mainly anything that could be used for police state powers.

They just have to remember to slap the name 'Patriot' on it, and their mouth breathers would be fine with it.

"The Godless Constitution," I learned that a lot of these laws stayed on the books because no one ever challenged them. No one enforced them, either.

For example, "There shall be no religious test for office." All sorts of states had that one on the books. It appears to be gone now.

The biggest group that was discriminated agains was Catholics. I remember all the flap about JFK running for office. I was in junior high then.
