GOP states sue Biden administration over student loan plan

WASHINGTON (AP) — Six Republican-led states are suing the Biden administration in an effort to halt its plan to forgive student loan debt for tens of millions of Americans, accusing it of overstepping its executive powers.

It’s at least the second legal challenge this week to the sweeping proposal laid out by President Joe Biden in late August, when he said his administration would cancel up to $20,000 in education debt for huge numbers of borrowers. The announcement, after months of internal deliberations and pressure from liberal activists, became immediate political fodder ahead of the November midterms while fueling arguments from conservatives about legality.

In the lawsuit, being filed Thursday in a federal court in Missouri, the Republican states argue that Biden’s cancellation plan is “not remotely tailored to address the effects of the pandemic on federal student loan borrowers,” as required by the 2003 federal law that the administration is using as legal justification. They point out that Biden, in an interview with CBS’ “60 Minutes” this month, declared the Covid-19 pandemic over, yet is still using the ongoing health emergency to justify the wide-scale debt relief.

“It’s patently unfair to saddle hard-working Americans with the loan debt of those who chose to go to college,” Arkansas Attorney General Leslie Rutledge, who is leading the group, said in an interview.

I live in a red state.
And I'm approaching retirement and took out thousands in PLUS loans to get my kid through college to get his degree.
That's in addition to the TENS OF THOUSANDS he took out to get his education and degree.

And you're saying just because we live in a red state "screw us??"

That 10 grand will mean an awful lot to me and my son as well as millions of others. Red state or not.

How is it that the government forgiving student loan debt, whatever the figure, is now the equivalent of, "...saddle hard-working Americans with the loan debt of those who chose to go to college."?

Let's see; what else does the govt "saddle" us all with; Military Aid, Foreign Aid, Petroleum Subsidies, etc.

Nobody - And, I do mean nobody, is going to feel anything in their paychecks because the richest nation in the history of the world is forgiving a very small fraction of student debt.

What the hell is wrong with people?

I have a SIL that's convinced these headlines are the death of her way of life. I always ask her post-outrage what happened to her personal finances or tax debt. She begrudgingly answers with, "Well,...nothing, really. That I've noticed."

The disconnect is brainwashing mind-numbing.

It's literally impossible to get a panel in that circuit at the appellate level that won't lean red. There are eleven circuit judges and seven with senior status.

Of the 18... one was appointed by a Democratic president.

On edit... and only one woman. The same "one" as above.

even have standing to sue in this case. But, I'm not a lawyer - and I'm not a Federalist Society judge.

Oh, there's always the argument that all taxpayers are "Harmed". But that could apply to everyone in the country for every item in the Federal budget. I would be able to sue the Administration because a Coast Guard station in Alaska bought a new coffee maker.

What cases they want or don't want to hear. They'll wrap their reasoning around whatever legal jargon they want to justify it. All the gop need to do is come up with some half ass legal argument and get it front of a friendly court and hope the court wants to play ball.
