Justice Dept. Seeking to Question Pence in Jan. 6 Investigation

The Justice Department is seeking to question former Vice President Mike Pence as a witness in connection with its criminal investigation into former President Donald J. Trumpís efforts to stay in power after he lost the 2020 election, according to two people familiar with the matter.

Mr. Pence, according to people familiar with his thinking, is open to considering the request, recognizing that the Justice Departmentís criminal investigation is different from the inquiry by the House Jan. 6 committee, whose overtures he has flatly rejected. Complicating the situation is whether Mr. Trump would try to invoke executive privilege to stop him or limit his testimony, a step that he has taken with limited success so far with other former officials.

Mr. Pence was present for some of the critical moments in which Mr. Trump and his allies schemed to keep him in office and block the congressional certification of Joseph R. Biden Jr.ís victory. An agreement for him to cooperate would be the latest remarkable twist in an investigation that is already fraught with legal and political consequences, involving a former president who is now a declared candidate to return to the White House ó and whose potential rivals for the 2024 Republican nomination include Mr. Pence.

Thomas Windom, one of the lead investigators examining the efforts to overturn the election, reached out to Mr. Penceís team in the weeks before Attorney General Merrick B. Garland appointed a special counsel on Friday to oversee the Jan. 6 investigation and a separate inquiry into Mr. Trumpís handling of classified documents, according to one of the people familiar with the matter. Mr. Garland has said that the appointment of the special counsel, Jack Smith, will not slow the investigation. Officials at the Justice Department did not immediately respond to a request for comment. A spokesman for Mr. Pence declined to comment.

2. Privelege might be waived since Pence discussed this in his book and on tv.

Not surprising that DOJ wants to talk Pence. Also, any privilege he might have tried to assert re his conversations with Trump are waived since he had no problem blabbing about them in his book and national TV

Pence has to testify. Can't use the "separation of powers" bullshit argument Pence uses to avoid testifying to Congress (J6 Committee) The Justice Department is under the Executive Branch, YOUR frikkin' branch of government.

Looks like Jack Smith won't be the tortoise some have suggested.

-- Pence hasn't once given any sworn testimony. This move is a pretty big one.

5. Am wondering about that filmaker

who was filming multiple people, including Pence, as this was going on. I believe some of the footage was shown during one of the J6 Committee hearings. This may be part of what DOJ might be looking for details about.

6. Didn't the film maker do a deposition? Which then gives the DOJ's SC the legal right to

call Pence in. And now that's he's no longer VP, privilege can't be his argument, right? So if he resists in court and gets overruled, he could be up for an 'accessory after the fact' charge is he doesn't tell all, imo.

This whole 'inner circle' presumption of special treatment by the DOJ has ticked me off. But it does also make sense that Pence would be the last to be called in by the DOJ.

7. The film guy testified publicly at a J6 hearing

and I think he may have given a deposition before that.

Given that Pence "publicly" did what was supposed to be done on January 6 - 7, and not put himself into the position of being the "fall guy" if he went along with the plot, he was forced to weigh being a target no matter what he did, and how to deal with it behind the scenes (which may be what DOJ wants to get details about). He knows he won't be on the ticket in 2024 as a VP and he may be trying to CYA in case he chooses to run himself.

11. Heard on MSM somewhere that he will run.

I think this is very bad since many people including some Dems, see him as a hero and even a survivor and not the possible accomplice or accessory he was.

Hope this whole situation moves fast and several people are impacted taking them either out of office or out of running.

Not holding my breath though.

9. Pence is a private citizen.

Subpoena him for both, and he will have to answer or look like a defensive jerk, the same as Trump

I get that you do more with honey and asking instead of telling, but if the law is on your side, just cut to the chase. We are running out of time. These assholes think they are above the law, and we have to coax them. BS to that.
