Florida wants child rapists put to death. SCOTUS has said it's unconstitutional.

Acting on a proposal from Gov. Ron DeSantis, Florida lawmakers filed legislation Wednesday to allow the death penalty for adults who sexually battery children younger than 12.
The bills would put Florida at odds with prior U.S. Supreme Court precedent saying that capital punishment can only be applied in the case of murder. But the bill sponsors Sen. Jonathan Martin, R-Fort Myers, and Rep. Jessica Baker, R-Jacksonville appear to be seeking a challenge of prior rulings.
A 2008 Supreme Court case, Kennedy v. Louisiana, and a 1981 Florida Supreme Court case were wrongly decided and an egregious infringement of the states power to punish the most heinous of crimes, the bills text reads.
DeSantis, when announcing his proposal in January, made similar comments.
We do not believe the Supreme Court, in its current iteration, would uphold it, and so we are going to be exploring ways to facilitate some capital trials if you have the worst of the worst, he said.

To me, this is a set-up to generate arguments solely for the purpose of casting liberals on the wrong side.

(3,856 posts)I'm against the death penalty, not because I think some people don't deserve it, but because I don't trust our justice system (or any) to get it right 100% of the time.
But... if we're going to have it, might as well throw child rapists in with the murderers.

(8,802 posts)very strongly that any proven, beyond a reasonable doubt, child molester, child rapist, True kidnapper, etc should be imprisoned for life with no chance of parole........
There is no cure, for what they have, and that has permanently messed with their brains....... Period.
Anyway, most of the child molesters I have heard about these past fifteen years, have been the Rich and Powerful, Politicians, or RW Idols.............

(2,992 posts)...recidivism rates for child molesters are not as high as people think. That's especially true for adolescents who commit such crimes - most don't re-offend if and when released, provided they get treatment.
I am NOT saying those who harm children shouldn't be treated severely. I'm only pointing out what, to me, was a surprising fact.

Regardless, the boy scouts, catholic priests, youth athletic teams, etc are breeding grounds and easy marks for Chomos.............and those individuals should be screened even more than normal........My son coaches teen age boys, and the organization he coached for ran him through three stringent investigations for starters, before they would hire him...... Their own investigation, Colorado State, and Federal, for starters........
And it isn't just men we are talking about here. Look at the female teachers with young boys these past few years.....
Sexual deviates, should be removed from society, in a prison with no chance of parole ever. There is no known cure........

(2,992 posts)I feel no sympathy whatsoever for some of those who are executed, and I probably wouldn't mourn much over the death of a child sex predator, but as long as the system is owned and operated by fallible human beings, the chance of error cannot be disregarded.
That being said - if they're going to keep or expand the death penalty, prosecutors should lose absolute immunity and be disbarred if they send the wrong person to death row and the execution is carried out. I don't care if the wrongful conviction was based on mistakes or misconduct - you help kill an innocent person, you lose everything you've ever worked for and you lose your job.
That might make some prosecutors think twice before calling for the death penalty.

Most white males from privileged backgrounds don't think that rules apply to them.
Also, unfortunately, some non-whites also let their lust for power be translated into lust for domination.

All Genotypes are equally susceptible to Delusions of Grandeur.
Arrogance is defined by belittling others. Grandiosity is defined by puffing one's self up.
Anyone that rejects doubt, has rejected reason.
Reason requires examination of facts. The predicate alone does not form a basis in fact.
I'm unaware of any vast sociological studies demonstrating a greater propensity towards grandeur for any particular human genotype.
Without supporting evidence, your assertions are left without standing.
May reason rule.

(518 posts)If the penalty is the same (namely death) for child rape and for murder, the child rapist might as well kill the child he has raped because (a) the penalty can't be any worse and (b) by killing the child witness he might get away altogether.
Desantis's proposal will lead to more child murders.
