Navy Reservist convicted of joining mob that occupied US Capitol

WASHINGTON — A federal judge convicted a Navy Reservist on all counts Tuesday for joining the mob that occupied the U.S. Capitol Building on Jan. 6, 2021, in an effort to stop the certification of the 2020 presidential election.

Hatchet Speed, of McLean, Virginia, was found guilty of one felony count of obstruction of an official proceeding and four misdemeanor counts by U.S. District Judge Trevor McFadden. McFadden delivered his ruling Tuesday following a brief bench trial last week.

Speed, a petty officer first class in the U.S. Naval Reserves, was arrested in June last year on four misdemeanor counts and later indicted on a fifth felony count of obstruction of an official proceeding. He was released after his arrest on home detention and GPS monitoring and ordered not to possess any firearms, destructive devices or other weapons. At the time of his arrest, Speed had been assigned to the Naval Warfare Space Field Activity at the National Reconnaissance Office in Chantilly, Virginia.

In charging documents, prosecutors said Speed told an undercover FBI employee he’d traveled to the Capitol with friends who were members of the Proud Boys and that going to the Capitol as “always the plan.” He said he’d entered the building in part because he’d heard former Vice President Mike Pence had “validated” certain ballots he considered “invalid.”

If his chain of command wanted to make a point, they could court marshal him for rioting or being away without leave (which he will be while in civilian prison) and discharge him with a bad-conduct-discharge if found guilty. More likely, they will just administratively separate him under other-than-honorable conditions. An other-than-honorable discharge still results the loss of most VA benefits.

Not only will he be dishonorably discharged but he will also lose his top secret security clearance. I know where he works and he just ruined the rest of his professional career in the intelligence community.

He had friends who were Proud Boys? He supposedly went (but had to have planned days before) because Pence had "validated" ballots he considered invalid, but at the time he joined the mob for travel to the Capitol, Pence would not have already certified the count. The states had certified their ballots, not Pence. So many of these people present had one or two pieces of fact surrounded by bullshit. He didn't really know how the process worked.

A psychologist wrote that the people who readily believe in conspiracies is because it makes them feel special, that they are "in" on information that isn't available to the majority of us. But jeez, he never explained that it eats their brains or something. So many people ruining their lives for the orange a-hole while he's living large and the fascism infecting more and more people that I would never have expected to become involved in the stupid and cruel.

Then there are the people at Fox who are still in it for the green.

McFadden set a sentencing hearing for Speed for May 8. Prior to that hearing, Speed will be sentenced in a separate case in the Eastern District of Virginia where a jury convicted him in January of illegally possessing unregistered firearms disguised to look like cleaning supplies.

The silencers were discovered during a search of Speed’s residence following his arrest in his Jan. 6 case. Prosecutors allege the silencers were part of a more than $40,000 “panic buying” spree by Speed following the riot. According to court documents, Speed told an undercover FBI employee the silencers could be useful when he "carried out a plot to hold ‘mock trials’ for and kidnap his enemies, starting with local targets, such as members of the Anti-Defamation League."

A dishonorable discharge can only be given by a military judge. He was tried and convicted in a civilian court.

Double jeopardy applies due to the fact this was by a federal court. Military courts are also federal courts. The military could only do this if it was a state court conviction.

No double jeopardy issue with NJP.

Lowest discharge type that can be awarded through NJP is "Other Than Honorable", but that would deny him retirement and other benefits.

Whether through NJP, or an Administrative Action (you can be administratively discharged for commission of a serious offense, or pattern of misconduct)...but either way his connection to the military SHOULD AND MUST be severed.

ALEXANDRIA, Va. (AP) -- A jury has convicted a Navy reservist from Virginia accused of storming the Capitol on Jan. 6 on separate charges that he illegally possessed silencers disguised to look like innocuous cleaning supplies.

The conviction Wednesday night against Hatchet Speed in U.S. District Court in Alexandria comes a month after a jury failed to reach a verdict in his first trial, resulting in a mistrial.

At the retrial this week, the jury needed only a few hours of deliberation before convicting him on all three counts of unlawfully possessing unregistered silencers.

Speed's case is noteworthy not only because of his alleged participation in the Jan. 6 riot with the far-right Proud Boys group, but also because he espoused antisemitic views in undercover recordings and discussed strategies for eradicating the Jewish population in the U.S.
