Indiana’s same-sex marriage ban now in federal judge’s hands

Attorneys from a national gay-rights organization today asked a federal judge to strike down Indiana’s law banning same-sex marriage.

That call came during a hearing in Evansville, where state officials countered by imploring the judge to uphold Indiana law that defines marriage as the union or one man and one woman.

U.S. District Judge Richard L. Young took the pleadings under advisement and will rule at a future date.

Young also took under advisement a request to extend indefinitely a temporary restraining order he granted April 10 that directs the state to recognize the marriage of Nikole Quasney and Amy Sandler who wed in Massachusetts.

I have no doubt, even without an upset on the Court, that within 10 years marriage equality will be the law of the land.

I think the path there will also resolve other outstanding issues such as ENDA. I believe the Court will have to rule in favor of marriage equality on an equal protection basis. If they do that they will almost have to classify LGBT persons as a protected class. If they do that then things like discrimination in employment, housing, etc. will go with them.

It is a slow march toward the finish line but we will get there.
