HEARTLESS: Associated Builders & Contractors Suing City of Lansing So Workers Can Be Paid Less

The Michigan Supreme Court has agreed to hear a case brought forward by the Associated Builders and Contractors (ABC) which questions the constitutionality of the City of Lansing’s prevailing wage ordinance. The ruling could have a far reaching effect in the state as Michigan has more than two dozen counties, cities, and townships with similar prevailing wage ordinances.

Fears were stoked that the state GOP would attack the prevailing wage during December’s lame duck session, but that did not materialize.

The ABC case began in 2012 when they sued the city of Lansing, questioning the constitutionality of its prevailing wage laws. The case progressed through the legal system and was most recently rejected by a Michigan Court of Appeals panel. They ruled the ordinance was “a valid exercise of municipal power because it does not conflict with the Michigan Constitution or state law.”

Randy Hannan, Executive Assistant to Lansing Mayor Virg Bernero, agreed with the appeals court decision, telling the Detroit Free Press:

“We believe the Court of Appeals got it right when they upheld our ordinance and we hope that the Supreme Court affirms that decision. Requiring prevailing wages on publicly funded projects is a policy decision that says we think it’s important to support our local economy, our local workers, our local families.”
