What’s happening now?



Oil is expected to start flowing through the Dakota Access Pipeline today. A federal Judge is expected to rule soon on the Standing Rock Sioux Tribe’s request that the pipeline be halted and the Trump administration’s approval be thrown out. The Judge still has the power to halt the pipeline.



“This pipeline became operational today, yet it has already leaked at least three times. This is foreboding as the company does not yet have a plan in place to address how they would contain and clean a serious spill,” said Standing Rock Sioux Chairman Dave Archambault II.


“We will continue to battle the operation of this pipeline in court and remind everyone that just because the oil is flowing now doesn't mean that it can't be stopped. The courts can stop it by demanding that the administration be held accountable for the full Environmental Impact Statement it initiated and then abandoned.”



On behalf of the Standing Rock Sioux Tribe, Earthjustice filed a motion for summary judgment on Feb. 14 on the major legal claims in the lawsuit filed against the U.S. Army Corps of Engineers to prevent the construction of the Dakota Access Pipeline under Lake Oahe near tribal lands.



All of the briefs in this case have now been filed. We are awaiting guidance from the Judge.
