Could Trump declare martial law to try to steal the election?
He’s thought about it. He’s hosted political and legal outcasts at the White House to talk about it.
Could President Trump declare martial law, or seize voting machines, or try to otherwise steal the election by force in his last month in office? Any of those would be an extreme escalation of Trump’s already unprecedented strong-arm tactics in his effort to overturn the election results. The answer is no, he can’t do this stuff, say various national security and election law experts. But even if these maneuvers aren’t in the president’s tool kit, it’s dangerous for him to talk about them in a way that risks normalizing them — let alone in Oval Office meetings, said nearly every expert The Fix spoke with. “This is really dangerous stuff to start playing with,” said Rachel Kleinfeld, a national security expert at the Carnegie Endowment for International Peace. “You cannot normalize extrajudicial action outside the rule of law and believe democracy will hold. 4. Yeah, I've been wondering the same plus he's a sociopath. He's liable to do anything whether
it can be done or not, as he does not give a damn about the laws or constitution and a host of things.

2. He can *declare* just about any words his stupid orange face-anus can form...
But a hell of a lot of those words are nonsense with no meaning or effect in the real world.

3. Trump can declare martial law by putting a pen to paper.
Whether or not the military and law enforcement follow that order is pretty much up to them at this point.

5. Knowing Trump he would send a coded message to his cult, the Proud Boys and
his Militia, they would jump at the chance at playing soldier - fighting to protect their leader. That's my worry.

6. Declaring martial law would change nothing.
Martial law has 2 purposes...restore order where local or state laws are being violated, or if we did not have functioning courts. Nothing would change.
Elections have been held during times of martial law. The election is over. The one thing that would change, civilians can have their firearms confiscated....the proud boys aren’t gonna like that! |

Trump could have (and arguably should have) declared martial law in April, when it was becoming obvious that the pandemic was out of control. This would have freed up military personnel to help manage the lockdown and enforce a quarantine for the couple of months it would have taken to get the virus under control. It would have been unpopular among his base, but it would have likely been effective in stopping the pandemic.
At this stage, however, he's lost the initiative, and any attempt to declare martial law would be met with near-universal resistance because it would be seen as being a political power grab in the face of having lost the election. He's also alienated the military, the national guard, and arguably even the quasi-legal LEO such as ICE or the DHS Capital Service. Martial Law is also not a coup. There are times where it is necessary to declare martial law, typically during an emergency, and usually in very limited (and clearly defined) scope. What Trump has been contemplating has been a coup to remain in power, and he lacks the power base to make that happen. |
