iPhone 5 clone maker to sue Apple over, um, iPhone 5 patent?

A report suggests that GooPhone, the Hong Kong-based company that created an Android iPhone 5 knock-off, has patented the design in China and will aggressively protect it.

I am frightfully excited about the iPhone 5.

Yet just as my excitement reaches the boundaries of human safety, along comes a report that suggests Apple might be sued over the iPhone 5's design.

Yes, sued.

You see, someone has allegedly already patented the rumormongered design in China. That someone is iPhone 5 knock-off maker GooPhone.

Enter Goophone I5, Looking a Lot Like Apple’s iPhone 5.

Want to get an iPhone 5 but can’t handle the wait for the Apple (AAPL) release later this month? You might consider buying a knockoff from Goophone. This little-known Chinese company has just announced the launch of its own iPhone 5 look-alike, the Goophone I5, and says it has already patented it in China, according to Gizchina.com. It may even consider suing Apple when the Cupertino (Calif.) company starts selling its sixth-generation iPhone in China, reports the tech and gadgets website.

though there have been some attempts to unify them, some of which are seriously over reaching.

Chinese courts have been markedly friendly towards their own nationals in such disputes. GooPhone may well win in China.

that Apple didn't patent the case design because it would have become public knowledge before the launch date.

First link I found to this subject I thought was a joke. It was when I found others I realised it wasn't.

Apple got laughed out of court on the subject of rectangles with rounded corners here in the UK
