1. Do you know any of the background on this one?

There wasn't anything at the site.

At least this family looks like they lived through it, unlike people stopped for DWB.

That kid is going to spend the rest of his life hating cops.

5. Coulden't find anything either.

After a second viewing I realized the one cop says "Our dog alerted on your vehicle". But my impression is that they said this because they realized the camera was going. Why didn't they say that when he asked them what their suspicion was? If the dog did alert it was probably because as she said, they just came from the doctor and had prescription drugs because they did not look nervous in the least entering that checkpoint. I don't care if he looks like he "could" be a drug addict, what occurred there was way over the line.

7. Yes, it was out of line.

I've denied entry to cops doing a door to door search by telling them to slip the warrant under the door so I could have a look at it. They left.

I don't think they liked the guy's looks--wiry, thin, beard, maybe a couple of tats, gotta be a tweaker or worse.

It's hard not to feel sorry for the kid, he was terrified. The kid is also likely why the guy didn't get manhandled more than he was.

That's pastor Anderson of "let's kill all the gays" fame.

The only reason him and his ilk are worried about the Bill Of Rights is because a Black Democratic President is in office.

39. Oh, he's definitely right (correct).

I just don't think he and his ilk, for the most part, gave a shit when Bush was in office.

I watch a lot of these YouTube videos: cop block, photagraphy is not a crime (founded by a former(?) DUer), honor your oath etc. etc. once you watch one, youtube feeds you a bunch more. Between these and aviation video, I can get sucked in on a Sunday

Sometimes I feel like we have common ground with these folks... Then I read the comments section ... and see comments that this is all "the statist commie fascist Kenyan Muslim Obama's fault" - totally ignorant of the previous 8 years of bush and patriot act or 35 years of reagan initiated drug war.

I've run in to the same attitude when crossing the border in Texas. Yes, there are good cops and border patrol agents; but damn, there are plenty enough of these types of thugs in the ranks as well.

Hope he gets a nice settlement from these thugs. Put his wife and little one through some real trauma.

...until I see these supposed good cops testifying against these so called bad cops I will have to presume they are all bad cops. That the bad apples have spoiled the barrel..

I will note. One of the first things the cop did when he had control of the car is to turn off the recording. These things should require a password to stop and should be hidden.

And never open your window more than is needed to speak through. Never. I hop that kid grows up hating cops. It is the reputation they deserve.

9. What border in the world could you behave this way and not have the border cops get bad with you?

1. Go to any international border in the world.
2. Behave this way
3. See how the cops react.

Slam me all you want, but I believe in being courteous, diplomatic, and cooperative at international border crossings. Especially if I'm responsible for other people who could be harmed by my refusal to cooperate.

Sorry, my "Stand up and and stick it to the man" attitude put me into too many handcuffs, squad cars, and holding cells. Eventually, I learned that it wasn't making anything good happen for me.

Tell him what you think of him, and don't let him order you around. Refuse to comply. Don't take any shit from this cop!!

Do everything you can to provoke the pig. I'll give you extra points if you pin him down by rolling his arm up in your electric car window while your car is running.

Get someone to film it, and then post it here on the Democratic Underground! You'll be both a victim, and a hero!

Comply, obey, be polite. Don't live your life but remember always be polite.

because they fear such a big, bad Freedom Warrior™ as you.

What international borders have you blustered and intimidated your way through without being restrained and investigated?

21. I must agree with you here.

Asking where you're going is SOP for border patrol agents. Point of the question is just to see your reaction, your eye contact, your general demeanor.
Dude behind the wheel totally asked for harassment, vehicle search, and got it. Some actions by the agent seemed a little out of line as well (reaching through the window) but had the driver just been a courteous traveler, it would likely have gone like:
I know I've been through these checkpoints hundreds of times. "Hi where you going?" (I state anywhere, smiling) "Cool dog" "Thanx" "Have a nice day" "Bye now".

28. You are not required to answer any questions. And that is the law of the land.

Different states have different rules about identification and all states have requirements about showing driver's license, registration, and insurance.

But other than that, you are not required to answer anything.

Did you see the video up thread where the minister was manhandled, tazed, and otherwise injured? He wasn't anywhere near an international border...

36. That's the problem,

all the checkpoints in the US are not at the border.

If you live anywhere within the orange colored zone, you may be stopped by Border Patrol for any reason they deem is acceptable, which by their definition includes sneezing, wrong hair color, color of skin, tattoos, male or female, anything. And then when they rough you up, they'll just say he looked suspicious and plant some drugs on you.

22. Actually, most of this was SOP except for the agent reaching through the window.

This is a border patrol checkpoint. Ever since Patriot Act, all of your vehicle is automatically subject to search at the patrolman's discretion automatically.
Had the driver simply acted the courteous traveller, didn't matter if he just bullshitted the officer about destination. The moment he flapped his big trap with "insubordination", he made himself a target for harassment and search.
I agree some of the actions of the BP officer were a bit out of line as well.
Regardless, had driver just acted a little bit more politely, he'd likely have simply been on his way outta there.

but I dont see what they did wrong. Guy was being uncooperative and really left them no choice.

They have a job to do to protective the US from people coming in the country illegally and bring in drugs or weapons.

Im glad they are doing their job. You lose certain rights leaving the country than coming back in. It wasnt like he was just crossing state lines.

Try getting into any country in this world and you go through a hell of a lot more than some questions

20. But if the cops thought with their brains

instead of their ego, they would be able to tolerate someone citing their rights. What smuggler would do that? I mean think about it. Yes, border crossings/customs can be tricky and most locals know which are more picky. Once my Canadian husband, was detained/questioned an hour for having a library card from a US city where he went to college. So they must have taken his wallet to start with. Thereafter, he carried proof of employment, citizenship- that was years ago though.

There are boarder patrol checkpoints all over the SW US along freeways and highways well away from the boarder.

25. They weren't crossing the border and he was being cooperative

I live in New Mexico and they have these stops on 1-25, I-10 and near White Sands, all about 30 to 70 miles from the border. They are there to catch drugs not illegals. He actually was being cooperative as he told them he was a US Citizen which is all he is required to tell the "Border Patrol". It may seem un-corporative to not tell them where you are going but the reason they ask that is to try and catch you in a contradiction so they can search your car. Lawyers will tell you to avoid saying more than you have to. Would I have told them where I was going? Yes, but he had the right not to and that doesn't make him uncooperative in the least.

41. This info from the ACLU is very interesting and useful. Everybody should look at it.

Thanks for posting this.

One snip from the long article>

Much of U.S. population affected

Many people think that border-related policies only impact people living in border towns like El Paso or San Diego. The reality is that Border Patrol's interior enforcement operations encroach deep into and across the United States, affecting the majority of Americans.

Roughly two-thirds of the United States' population lives within the 100-mile zone—that is, within 100 miles of a U.S. land or coastal border. That's about 200 million people.

Connecticut, Delaware, Florida, Hawaii, Maine, Massachusetts, New Hampshire, New Jersey, New York, Rhode Island and Vermont lie entirely or almost entirely within this area.

Nine of the ten largest U.S. metropolitan areas, as determined by the 2010 Census, also fall within this zone: New York City, Los Angeles, Chicago, Houston, Philadelphia, Phoenix, San Antonio, San Diego and San Jose.

snip> much more at link.

I don't care if this is border patrol or not. No one deserves to be treated like this, with no reason for suspicion. I'm sure a dog alerted them about his car. Yeah right!!! I didn't see any dog. Unfortunately we don't know the end of the story. Did he have any drugs, or anything illegal?

Police reform is in desperate need in this country. You don't treat people like this. Bernie Sanders agrees, and is the only candidate talking about this.
