Grand Jury Confirmed? Judge Explains How Immunity Indicates Jury Already Seated

Yes, this is from FoxNews and I groan along with that, but what is being explained I could not find elsewhere so posting with caveat. From what is said about Bryan Pagliano's immunity:

- Immunity can only be granted by a Federal Judge
- A Federal Judge would only grant immunity for prosecutors in a sitting Grand Jury
- Immunity would only be granted if information the witness has would assist prosecution
- Prosecutors grant temporary 1-day immunity to hear what witness-evidence exists prior to full-immunity
- Evidence given by witness would have to be sufficient to indict someone in a Grand Jury

Could be this is going after someone in the staff, but often they will indict in order to force another witness to testify higher up in the chain, so this may be one part of a larger process.

Obviously much of what Napolitano says is complete right wing talking points, but you can filter that out as the process of granting Federal immunity, and what it indicates, is what is noteworthy and I have not seen other information being provided regarding this case. Again, please filter out as needed, especially when he starts talking 'espionage' as I don't think this rises to that of course.... FoxNews-types just can't help themselves.

You don't need a judge to grant immunity. Pagliano probably got letter immunity, not statutory immunity. That means DOJ sent him a letter saying he won't be prosecuted no matter what he says. So none of this proves there is or isn't a grand jury.

Btw, Napolitano was never a federal judge or prosecutor.
