The ACLU isn't primarily concerned with getting convictions, but DAs are. I think it's so improbable that the officer will be found guilty on any count, that setting the bar to a lower charge might improve the chances of a conviction somewhat.

Getting a police officer to do real hard time for unjustifiable killing is, possibly, more important right now than going for a more serious offense and falling short. There is no lesson to be learned or deterrence in the latter. (Whether there is in the former is also a good question, but we do what we can)
