Reason 1: Makes no sense, because Bill Barr already knows what's in the memo !

Reason 2: I can see the merit in that, but the optics of Garland defending potential criminality within the DOJ looks appalling, and smacks of defending the institution no matter what. It taints his leadership only a short few weeks into it.

Reason 3: Obviously not the case, but if Barr walks away, then it will show utter naivety by Garland.

has been badly tarnished by the last four years, and defending the internal DOJ internal deliberative process while knowingly shielding the disgrace that is the liar Barr, will do nothing to give any confidence back in the DOJ. This should be a house cleaning moment. Now, perhaps they believe that they will be defeated in their appeal, and this allows them to not set a precedent but get the right result in the end, but the optics are terrible. Even worse if an Appeal Judge lets them off the hook.
