Johnson Utilities seeks $450 million in damages from ACC

SAN TAN VALLEY — As Johnson Utilities complies with a judge’s order to cooperate with an interim manager, its owner continues to fight the Arizona Corporation Commission with every legal option available.

The same week EPCOR officials entered Johnson Utilities facilities and got access to financial systems, George Johnson filed a notice of claim asking $450 million from the Arizona Corporation Commission for damages incurred by the interim manager order. Johnson claims that the ACC has taken Johnson Utilities’ property in violation of the Fifth Amendment of the U.S. Constitution.

The ACC disagrees with the position in the filing and has always held that the appointment of an interim manager does not take ownership rights away from George Johnson.

The claim argues that the ACC decision allows EPCOR to interfere with GJH Trust’s ownership rights and “makes that ownership virtually valueless,” constituting a violation of the Fifth Amendment, which says the government cannot take property from its citizens without just compensation.
