Former Muscatine police officer sentenced to up to 10 years in prison

District Judge Mark Lawson sentenced Tovar, 49, to up to 10 years in prison.

"You violated a public trust. Hopefully, this will send a message to the community that no one is above the law," Lawson said directing his remarks at Tovar.

Tovar was an on-duty officer with the Muscatine Police Department in February 2013 when he drove the victim, (note: I will exclude the name - it is in the article), to the Clarion Hotel in Muscatine after her boyfriend was arrested for operating a motor vehicle while intoxicated.

Tovar than proceeded to have sexual intercourse with her. Martin testified she was intoxicated, and had little memory of the night.

that is usedby prosecutors to cover rape and other sexual crimes when committed by the police. They are much milder charges.
