Kentucky State University disputes AG’s legal standing in lawsuit against University of Kentucky’s student newspaper, the Kentucky Kernel

A Franklin Circuit Court judge will soon decide whether the Attorney General’s Office has legal standing to intervene in a lawsuit between Kentucky State University and the University of Kentucky’s student newspaper, the Kentucky Kernel, over an open-records dispute.

The Kernel requested records containing sexual-assault complaints from all state colleges and universities last year, but unlike Western Kentucky University and UK, which have opposed those records requests, KSU has also objected to Attorney General Andy Beshear’s office intervening in the lawsuit, saying the attorney general doesn’t have legal standing.

In January, Beshear ruled that KSU violated the Open Records Act by not providing the requested sexual misconduct investigation records. The universities have additionally not allowed Beshear’s office to review the disputed documents confidentially — a right he has said the office is allowed by law.

The student newspaper has a similar lawsuit against WKU, but last week in Warren County Circuit Court, the university did not oppose Beshear’s right to intervene.
