ACLU, NAACP group call Flint water liens unjust -- and maybe illegal

FLINT, MI -- The American Civil Liberties Union and NACCP Legal Defense and Educational Fund are asking Mayor Karen Weaver and the Flint City Council to issue a moratorium on the placement of liens on Flint homes for unpaid water bills.

In a letter to Weaver and the Flint City Council Tuesday, May 16, Kary L. Moss, director of the ACLU of Michigan, and Sherrilyn Ifill, president and director-counsel of the NAACP LDF, Inc., say the city is not legally required to place liens on properties with overdue bills -- something Weaver suggested earlier this month.

A news release says the NAACP Legal Defense & Educational Fund is also urging city officials to suspend the local lien efforts.

"Not only is placing liens for unpaid water bills on Flint homeowners' properties unjust, but it raises serious legal concerns," Moss wrote. "Initially, when the city enters into an agreement to provide water to Flint residents in return for payment, there is an implied agreement ... that the water is fit for drinking."
