The Fourth Amendment protects Americans from random and arbitrary stops and searches. However, that doesn't necessarily apply to those who fall within the governments 100-mile "border zone." Since Michigan is surrounded by the Great Lakes, it is considered such a zone and the zone covers the entirety of the state, as you can see in this American Civil Liberties Union map. (In fact, two-thirds of the countrys population more than 200 million citizens lives within these border zones.)
Federal agents are granted "extraordinary powers" to search people or vehicles without a warrant in these border zones. But the "extraordinary powers" granted within these zones does not mean federal agents are constitutionally exempt. Agents are not allowed to pull someone over without "reasonable suspicion" of an immigration violation or crime and cannot search a vehicle without a warrant or "probable cause."
According to the ACLU of Michigan, people have the legal right to tell border agents the following even if they are undocumented:

(43,890 posts)1. My son witnessed such an event in Mission, Tx two days ago
He saw a group of CBP officers, 4 vans, surrounding a group of what appeared to be 'mojados'; illegal border crossers.
They had them surrounded, sirens blaring, flood lights on them, guns drawn, with the group in the middle, on their knees, hands on the back of their necks, fingers interlaced.
Including in the group were many females, some of whom appeared to be 12 year olds at most.
My son guesses there were maybe 10 individuals in the group captured by our brave men in green.
I feel so much safer now.

(36,841 posts)2. That makes me sick to my stomach.
I can't imagine the terror that those people felt (especially the young ones). This is not my country.
