The DREAM Act Comes Up Two Votes Short In New York State Senate

In a surprise move late Monday, the state Senate took up debate of the DREAM Act and fell just two votes short of adopting the measure.

Thirty senators – all of them Democrats – voted in favor of the bill, which would enable the children of illegal immigrants to receive state tuition assistance. Only 29 senators voted against the bill but it still fell short of the 32 needed for passage.

Republicans were joined in opposing the measure by two Democrats: Ted O’Brien of Rochester and Simcha Felder of Brooklyn. Lawmakers, with little advance notice, began debating the bill shortly after 5 p.m. It had been approved by the Assembly earlier this year.

“Six months ago, no one would have wagered that the DREAM Act would make it to the Senate floor in an election year, let alone come within two votes of passing,” said Queens Sen. Jose Peralta , a Democrat and sponsor of the measure.
