Lawsuit filed on behalf of 61 Tyre residents

TYRE — Before the Pledge of Allegiance could be recited Thursday night, the Town Board was served with a summons and complaint related to the proposed casino project.

After the roll call, Geneva lawyer Mario Fratto walked up and gave each board member a copy of the lawsuit. Fratto also gave one to town Planning Board chairman Robert Seem, who was sitting in the audience.

Fratto said the summons and complaint were filed in state Supreme Court of Seneca County earlier Thursday.

The suit lists 61 town residents as plaintiffs. The town, the Town Board, Supervisor Ron McGreevey, the Wilmorite Corp. and Seem are named as defendants. It seeks a declaratory judgment that the Planned Unit Development law passed by the Town Board Feb. 20 violates town and state laws and should be declared null and void.
