Appeals court cases: Fired school band director can sue principal
Former middle school band director Joseph Gilreath can continue his lawsuit against the school board, the North Carolina Court of Appeals said on Tuesday.

In the school board matter, the Cumberland County Board of Education fired Gilreath in November 2012. He had been the band director and music teacher at Anne Chesnutt Middle School.
“The grounds listed were ‘immorality, insubordination, and neglect of duty,’” the appeals court ruling says. Gilreath had previously been suspended with pay because of “a concern about a demonstrated pattern of inappropriate and unprofessional communication in the workplace with students, parents, and supervisors,” the ruling says.
He filed this lawsuit in October 2015, alleging breach of contract, intentional infliction of emotional distress, violations of the North Carolina constitution and other violations of state and federal law. Acting as his own lawyer, Gilreath filed it against the Board of Education, Superintendent Frank Till Jr. and Anne Chesnutt Principal Tonjai Robertson.
