The Ohio Supreme Court Rules Against Mound Builders Country Club in Newark Earthworks Case

Big news for almost everyone concerned. We can expect an appeal but things are looking up!

In November 2018, the Ohio History Connection, previously the Ohio Historical Society, filed a civil lawsuit against Moundbuilders Country Club, intending to buy back the lease on the Newark property, which has been operated as a golf course since 1910.

On Jan. 29, 2020, the Ohio Fifth District Court of Appeals rejected a Moundbuilders appeal, affirming a May 10, 2019, decision of Licking County Common Pleas Court Judge David Branstool that OHC has the authority to acquire the lease by eminent domain.

1. Seems the lawsuit went two ways. Confusing.

Country Club can't buy it back, but because they already applied for status as World History Site, it isn't necessarily a public access issue???

If it ALREADY has a World History Site status, then shouldn't it be protected now?

2. It sounds like the Historical group will proceed as directed.

The world of eternal litigation is designed by a madman. At any rate things seem hopeful! This is exciting as the mounds are throughout the community. Those throughout the golf course would be nice to explore. Fingers crossed that they can wrap this up!

3. Like Ohio needs another golf course anyway

Whoever thought putting a golf course practically on top of an historic Native American site anyway? Stupid and disrespectful at the very least.

4. It looks like the Country Club has leased the land since 1910.

But hey the Native Americans had it 1900 years before that. 😁 It’s about time the community set things straight. And like you say , there is zero shortage of golf courses!
