Court agrees to speed Texas gay-marriage case

A federal appeals court agreed Tuesday to expedite a case that will determine whether Texas can continue banning same-sex marriage.

The 5th U.S. Circuit Court of Appeals agreed, without elaboration, to speed the case but did not schedule oral arguments. Attorney General Greg Abbott has until Friday to submit the final brief in the case.

The case has been pending at the appeals court since February, when a federal judge overturned the Texas ban on same-sex marriage as unconstitutional. Two same-sex couples involved in the case asked the court to expedite the case because one of the couples — Nicole Dimetman and Cleopatra De Leon of Austin — is expecting a second child in mid-March.
