Judge: Sherwin Alumina should have allowed union inspection

GREGORY, TEXAS -- Sherwin Alumina Co. should have permitted a union representative to observe federal inspections of its Gregory plant, a judge ruled.

United Steelworkers Local 235A interpreted the ruling by Administrative Law Judge Thomas P. McCarthy as a victory for the 450 Sherwin employees it represents, but conceded its 11-month lockout with the company remained at an impasse.

In a 34-page ruling Friday, McCarthy said Sherwin should have allowed Sherwin employee Joe Guzman to accompany Mine Safety and Health Administration personnel during inspections of the plant last year.

Guzman, also a union representative, was prevented from entering the facility on Oct. 20, just nine days after the company imposed a lockout. Guzman was kept from another inspection in November.
