Judge will stay on case despite Attorney General Ken Paxton's request to boot him
AUSTIN The judge presiding over Attorney General Ken Paxton's criminal case has decided to remain on the job despite Paxton's requests he be removed.
Judge George Gallagher will not step down, court clerk Tommie LaRue confirmed to The Dallas Morning News early Monday. Paxton requested Gallagher be replaced on the case just after the judge decided his upcoming trials should be moved from Collin to Harris County.
"The Judge will remain on the Paxton case," LaRue said in an email. "He does not need to rule on Paxton's Motion to Remove him."
Gallagher's decision to move the trial out of Collin County, where Paxton has lived and worked for years, was a blow to the attorney general who'd been riding high earlier this year after beating federal civil charges based on the same allegations that he broke securities laws. His request to remove Gallagher by citing a procedural clause in Texas law was likely unprecedented, The News first reported last week.
