Texas’ near-total abortion ban will remain in effect as federal appeals court agrees to hear legal challenge

Texas’ near-total abortion ban can continue to be enforced while the law’s constitutionality is decided, a panel of federal appellate judges ordered late Thursday.

The three justices of the 5th Circuit Court of Appeals — considered as perhaps the most conservate appellate court in the nation — also agreed to hear oral arguments in the underlying lawsuit the Biden administration filed against Texas over the law.

A U.S. District court previously blocked enforcement of the law for two days before the 5th Circuit initially froze the order. The panel of 5th Circuit justices on Thursday agreed in a 2-1 decision to let the law remain in effect until it considers the U.S. Department of Justice’s challenge. Judge Carl Stewart dissented.

The decision means the appellate court will now take over the legal challenge that was being overseen by U.S. District Judge Robert Pitman.

always thinking of new ways to control women and make life miserable for them, while men just did whatever they wanted to do. Single was bad, divorced was worse for us.
