GOP fires back at Virginia Beach man's lawsuit that accuses the party of fraud for failing to repeal

NORFOLK -- “Political disappointments” aren’t criminal, and a federal lawsuit accusing Republican leaders of such should be tossed out, their lawyers argued this week.

Attorneys for the GOP and its leaders asked a federal judge to dismiss a Virginia Beach Republican’s lawsuit accusing the political party of fraud and racketeering for not abolishing the Affordable Care Act after raising money promising to do so. The lawsuit argues that the donations should be returned.

“The lawsuit is an unprecedented attempt to repurpose an anti-Mafia statute as a means of punishing a political party for alleged shortcomings in achieving political objectives,” wrote attorneys Todd Steggerda and Brian Schmalzbach in a dismissal motion filed Monday.

“Allowing this case to proceed would create an open invitation for partisan donors to drag every political disappointment straight to the courthouse.”

Maybe what America needs is for our courts to get more involved, or for politicians to quit lying when they run for office!!!

Seeing as to how politicians can't seem to get elected without telling even a few lies, this anti-Mafia statute, might be a good way to go!

The Constitution prohibits this kind of garbage lawsuit under the legislative immunity provisions of the free speech an debate clause.
