http://www.jsonline.com/watchdog/noquarter/proposed-gop-resolution-asserts-states-right-to-nullify-laws-secede-b99259782z1-257427991.htmlDelegates at the state Republican convention are set to vote Saturday on a proposed resolution that directs lawmakers to push through legislation nullifying Obamacare, Common Core educational standards and "drone usage in the state of Wisconsin."
"Be it further resolved," the proposal concludes, "that we strongly insist our state representatives work to uphold Wisconsin's 10th Amendment rights, and our right to, under extreme circumstances, secede, passing legislation affirming this to the U.S. Federal Government."
Republican officials had confirmed that the so-called "state sovereignty" resolution made it onto the agenda for the convention, which is being held in Milwaukee beginning Friday. But the wording of the actual resolution had not been made public.

(13,218 posts)I thought we fought a war over this very issue and decided "nope".
Didn't we have a war in the middle of the 19th Century over this question? Wasn't it settled at that time? Are these opportunists actually advocating fighting that war all over again?
If so, our history teachers have failed us miserably.

Article VI of the Constitution makes it very clear that federal law trumps state law. It is known as the supremacy clause. Subsequent court decisions have rejected the notion that states can nullify federal law. Only courts can nullify law.

(5,279 posts)The (state government) system appears to be rigged here. The Democrats seem to be in collusion with the republicans. I only know of a few who aren't DLC leaning.
We are the living embodiment of needing to get money out of politics.

(9,740 posts)I would not say collusion as much as neutered and still in disarray from the 2010 Tea Party Blitzkrieg and failed recall. Until then the GOP rules the state and can push any and all ALEC/Koch test cases they want. How fast can Wisconsin change into Wississippi?
Along with the ground game in the area that brought this succession request (greater WI-6 State Senate area I have read, somewhere East Central WI). It is also a Dominionist Christian test case in the state. How can the US be changed into a open feudal state, WI is one of their test cases to go from a blue to deep red state. From restricted laws in voting to overall civics, a return of more open racism which is less and less veiled, to the Prosperity Theology at those Domionist churches that make having money the end all.
It is more than just law change, it is a extreme change in our society test case.

(1,665 posts)2010 spanked WI so hard, and the RWNJ's elected put so much emphasis on the NJ part of RWNJ, that for another year it's theirs to play with however they want. WI voters gave them the state, lock stock and barrel, and these rethugs are determined to make sure to absolutely destroy it before they have to give it back.

(297 posts)very different DU reaction over what appears to be the same issue -- whether or not states can ignore federal law.

(53,475 posts)Here in Wisconsin, there has been talk of arresting federal officers who try to enforce federal law, implementing the ACA for example.
I'm not aware that Colorado or Washington has threatened to arrest any federal officers.
Interesting point, though, and a fine one at that.

(53,475 posts)The Milwaukee Journal Sentinel reports that the nine state lawmakers told the Tea Party-aligned Campaign For Liberty that they support authorizing "state and local law enforcement to arrest federal officials attempting to implement the unconstitutional health scheme known as Obamacare."
One of the nine lawmakers backing Campaign for Liberty's proposal is state representative Chris Kapenga (R-Delafield), who told the Journal Sentinel that he believes the health care law is unconstitutional.

Exactly who are these people, by name?
I expect to see Glenn Grothman's name on this list.
