Fire union bad-faith suit dismissed

The state labor court has dismissed a fire union lawsuit that accused the city and five City Council members of bad-faith labor negotiations.

Fire union attorneys said the council engaged in “surface bargaining” negotiating under the pretense of bargaining, but never intending to reach an agreement during its involvement in talks over a new labor contract for city firefighters.

But the labor commission said there was not enough evidence to prove the allegations.

“We agree that the record of bargaining by the city shows a long-term pattern of hard bargaining and unilateral decision-making, which is, to say the least, not conducive to creating an atmosphere in which a negotiated agreement could be reached,” said the ruling issued Tuesday by the state Commission of Industrial Relations.
