AG asks judge to keep W.Va. same-sex marriage lawsuit on hold

West Virginia Attorney General Patrick Morrisey wants a federal judge to keep the lawsuit challenging the state’s same-sex marriage ban on hold until a ruling in a similar Virginia case is final and the U.S. Supreme Court reviews it.

Meanwhile, attorneys for three same-sex couples suing over the state’s ban asked the judge Wednesday to immediately lift the stay, deny Morrisey’s request for a lengthier wait and rule in their favor.

Morrisey also asked U.S. District Judge Robert C. Chambers to schedule arguments in the West Virginia case over whether three gay couples in West Virginia should have sued state officials, rather than county clerks.

On Monday, a three-judge panel for the 4th U.S. Circuit Court of Appeals upheld a federal judge’s rejection of Virginia’s longtime ban on same-sex marriage. Chambers said in June that he was waiting for the 4th Circuit decision on Virginia’s law before proceeding in the case before him....
