New York governor proposes strictest assault weapons ban

(Reuters) - New York Governor Andrew Cuomo pledged to enact the strictest assault weapons ban in the United States and outlaw all high-capacity magazines in one of the first state-level reactions to the massacre of school children in Connecticut.

"Gun violence has been on a rampage as we know firsthand and we know painfully," Cuomo said on Wednesday in his annual State of the State address, in which he committed New York to leading the country in enacting new gun control laws. "We must stop the madness, my friends. And in one word it's just enough. It has been enough."

New York and Connecticut already have among the toughest gun control laws in the country, but Cuomo has complained New York's ban on assault weapons, for example, is so full of loopholes that it is unenforceable.

The law bans magazines with a capacity greater than 10 rounds but exempts magazines produced before 1994. Cuomo said it was virtually impossible to determine whether any magazine was made before or after that date, so he proposed eliminating large capacity magazines regardless of date of manufacture.

Law generically requires full market price which is pretty good these days.

Either that or New Yorkers who decide to comply could sell them (via an FFL) to citizens in other states. Might be a bit of a local stimulus

My cousin contacted me, I'm making space in my safe for storage this weekend. We may end up moving his safe. Completely legal.
BTW private sales of long guns state to state are for the most part still legal w/a few exceptions. It's the handguns that require an FFL transfer. But storage is 100% on the up and up. NY -8 million rifles, PA +8 million rifles.

That is why things are grandfathered. The fair market price buy back costs would be staggering.

The whole law was drafted behind closed doors. (Taxation and legislation without representation.) He's planning on no grandfathering. The problem is he's made no plans to collect the firearms that were already illegal yet he's willing to go after some senior citizens who've collected Garands. No historical exceptions to be made. Guys who shoot CMP matches will be storing a few rifles in my safe. The guy trampled on a lot of veterans and a lot of senior citizens.

He specifically stated he was not going to take our guns but he was addressing hunter only. I say don't think about elephants. I wonder if they'll set up road blocks at the NY borders to contain hidden criminals. I feel sorry for NY'ers.

The courts may step in since there will certainly be lawsuits. Full market price buy backs are black letter law.

Talk like his helped fuel the buying panic that is going on. Ever see gas lines and grocery stores right after a hurricane? It's like yelling fire in a movie theater.

The mantra was that we "need to have a discussion" apparently in NY that did not apply. Cuomo may have done more to ruin chances of solving a national problem than the NRA did/does.

Apparently people have told him that lie often enough and he believes it.

In the speech he admitted he owns a Remington shotgun. By definition he's a hidden criminal.

Arrogant NY's are in a class all of their own.

given his statements, Gov Cuomo can probably say goodbye to becoming President. It is unlikely he would be able to get elected since his statements in the OP will cost him many of the swing states
