Florida Gun Gag Law Overturned

Court Overturns Florida Measure Preventing Doctors From Asking About Gun Ownership

A federal appellate court Thursday struck down a Florida law that prohibits doctors from asking patients about firearms ownership, saying the so-called gun gag law violates doctors’ free speech rights.

The 11th U.S. Circuit Court of Appeals, in an en banc ruling in Miami, said the anti-harassment provision of the Firearm Owners Privacy Act is unconstitutional.

The judges, however, upheld the law’s anti-discrimination provision, which prevents a doctor from refusing to treat a patient who owns a gun.

1. So ...

... how do you feel about doctors asking about driving skills, eating habits, hygiene, and sexual proclivities? All of these have potential impacts on the health of the individual, the family, and the society at large.

The judges, however, upheld the law’s anti-discrimination provision, which prevents a doctor from refusing to treat a patient who owns a gun.

Or one who refuses to answer the questions, which was the original impetus for this legislation.

Happily bantering back and forth, forth and back over why Scalia was wrong in Heller and what the 2A doesn't mean.
As soon as the question of what is covered by the RKBA for individuals, it's like I needed to go on the hunt behind bushes and under rocks to get an answer. Not that I did but all I can infer is a reverse paraphrase of Justice Potter: 'I'm not sure what it is, but I know when I see it what it is not.'

Just more BS with an anti-progress effect.

7. OK, let's do this in a bit more detail.

eating habits, OK by me

OK by you if the doctor asks, "How often do you eat junk food? How many calories a day do you consume, on the average? Do you ever binge on ice cream or other sweets?"

hygiene, OK by me

OK by you if the doctor asks "Do you bathe/shower every day? Do you always wash your hands before eating? After using the toilet? Do you ever eat food that has fallen on the floor?"

and sexual proclivities? OK by me

OK by you if the doctor asks "How often do you have sex? Do you engage in oral sex? Anal sex? Any fetishes? Do you have unprotected sex with strangers?"

And in all of the above instances, as with the gun issue, doctors could offer plenty of useful health and safety information without asking the intrusive questions and making sensitive information a part of a person's enduring medical record.

I'd prefer to leave the color of your shit out of the discussion, much as you seem bent on including it.

Well aren't you the privileged one! Some people don't have the luxury of those "mega choices." But we'll just put you down as OK with doctors refusing to treat patients who won't respond to irrelevant and intrusive questions. Doctor always know best, right? Sometimes withholding treatment is the appropriate protocol, right?

6. So what are the consequences of being less than truthful with a doctor?

If my doctor asks me if I am engaged in a life choice to which I respond opposite to my actual behavior, do I receive punishment?

I fail to see where a doctor is going to effect private ownership of guns.

But there again, we live in the normal world, where people do not cower in abject fear of inanimate objects, we laugh at those who do...

13. Most of the doctors and dentists I have had over the years in Florida discussed gun ownership ...

with me.

We talked about their hunting experiences and my experiences target shooting pistols. I've had one ask me which I thought was the better pistol, a 1911 style .45 automatic or a Glock.
