If it was not previously, even the most loyal Clinton supporters should by now recognize the seriousness of her problems. The FBI does not assign 147 people to investigate something trivial, allowed or lacking national security implications.
How can she be so selfish to continue in the primary while there is an active FBI investigation against her?

(37,428 posts)Until the knowing transmission of then-classified info by unsecured means is tied to Clinton, I don't see any meat to this story. 793 contains a huge loophole.
leveymg
(36,418 posts)In addition, 22 emails containing TS/SAP materials were sent to her.
In total, more than 2,000 documents containing materials at various levels of classification were found on her private, uncertified server, which she didn't even notify the Department she retained after leaving government employment for more than two years.
* Did she turn over materials that were in apparent breech of classification protocol over to DSS or to the originating agency? No.
* Did she know they were likely classified and on an unsecure server? Absolutely.
* Did she sign a security agreement on which she agreed to not disclose classified materials AND to also stop and report breeches of security? Yes, she did that on 01/22/09.
That's no loopholes that fit her neck. Just gold ringlets. She's handed herself to the hangman.
grasswire
(50,130 posts)If she DID think she might be discovered and went ahead anyway, we can only consider some sort of ego pathology at play.

(37,428 posts)Retroactive classification is specifically loopholed in 793, and "knowingly" is also key.
People knowingly forwarding or cutting and pasting would be in breach, if the information was classified at the time, but every story I've seen waffles on these points.

(37,428 posts)793 is pretty specific about how to fuck up. Has to be knowingly, and after-the-fact classification has no bearing.

(59,498 posts)It is much better to just post the WP article that this is essentially based on. It is far more measured and attempts to explain what is known about the entire email debacle.
I think that Clinton's judgment was horrendous and that it has given us a window thru how she managed her job as Secretary of State. While many saw how hard she work and occasionally her sense of humor, the negatives I see are:
1) No willingness to change from what she wants to comply with what authorities said was needed.
2) A willingness to ignore the Obama administration rejecting Sid Blumenthal - and setting up what may be a conflict of interest - having him employed by the Clinton Foundation, but working as an adviser to her. (bonus: he may have had no security clearance, yet he passed on highly classified info.)
3) Not illegal --- One comment about HRC over the years is that she creates cocoons of a small number of very close, very trusted advisers and relies almost exclusively on them. This is clearly seen in the analyses of the emails. There is no reason to think that is not how she would operate as President.
leveymg
(36,418 posts)I agree that the Post article is far, far more informational and credible.
When you have some time, take a look at the material compiled on Paul Thompson's thread, here: http://www.democraticunderground.com/?com=view_post&forum=1280&pid=158157 I have 5-6 posts on that thread with more than a dozen reputably sourced articles that point to FBI Director Comey reporting she violated several federal statutes, but not the one's mentioned in the Post article. I argue that that the main statutes will be 18 USC 793 (e) and/or (f).

I truly hate the "others did it too" meme.
The "others" you speak of are Condi Rice and Collin Powell. Not exactly paragons of good judgment and trust. I make this point to determine if it is intent of the users of this meme to now also defend the actions and poor judgment of the shrub administration.

(10,472 posts)Please don't pretend that you ever gave a second thought to a cabinet official's use of email before now. You and Judicial Watch and the GOP (what a happy threesome!) use this for a political football, not out of a genuine care for security.

I do not recall ever having had a conversation with you on this or any subject before now.
Seriously, dial it back a little. You are already dialed up to "11" and trying to attack my integrity right out of gate.
I am more than willing to have a discussion on the merits of the investigation and of information security. I am not willing to entertain trash excuses like "everyone else is doing it". That is something little kids say. Adults, at least responsible adults, know how the world works. Sometimes you get caught for speeding, sometimes you don't. Regardless, speeding is always illegal.
I await your well-reasoned reply.

Sanders can't win a majority of the votes, so let's indulge every right wing conspiracy theory in hopes of overturning the results of democratic elections and installing Bernie in power despite being rejected by a majority of democratic voters.
That's what I call a pretty sad acknowledgement that your guy can't win.
