But this isn't the kind of thing that is generally done by the FBI. It would have to be done at the request of congress, and I don't see that happening.

Loretta Lynch is still Attorney General - this CRIME happened on her watch...

She can ORDER the FBI to investigate this. Why wouldn't she? ONLY THE FATE OF THE NATION IS AT STAKE HERE!!

The only thing worse than Trump would be to normalize the idea of "locking up your political opponent", especially since we railed against Trump for doing the same thing. He's a Constitutional Law scholar to the end.

I'm not sure I fully agree but I see where he's coming from. He also likely sees the fact that 40% of the country would never accept the legitimacy of locking him up, no matter what evidence was produced or how disgusting it is.

some future Hillary Clinton getting prosecuted by some future Donald Trump for beating him in an election (the fact that Trump's treason is *real* is irrelevant in a post-truth age) and pointing to Obama having Trump dragged away in handcuffs as a precedent. That's also why I strongly opposed even the hint of say, an anti-Trump coup if shit got really bad.

America is as much a nation of *precedent* as it is a nation of law.
