Major Concerns in Virginia HD-28, Including Disenfranchised Voters, “Split Precincts,” Call Election Results Into Serious Question

I just got off a call (see audio below) with Virginia House Democratic Leader David Toscano and Marc Elias of Perkins Coie’s Political Law practice regarding some VERY serious concerns about the election last Tuesday in Virginia HD-28 (Fredericksburg City, Stafford County). Note that the State Board of Elections website currently shows Republican Bob Thomas, Jr. leading Democrat Joshua Cole by a slim margin of 82 votes (11,842-11,760). However, there are now not only questions about absentee ballots that were not counted in Stafford County, but also – as Marc Elias explains – very serious questions regarding possibly illegitimate “split precincts” in Fredericksburg City.
On the first issue, Elias stressed that Stafford County must count the 55 absentee ballots that have not yet been counted and that those 55 Virginians “should not be disenfranchised because of errors made by government officials.” Elias added that the Stafford County Registrar himself stated, “There is no possible way that these ballots should not have been available to the Registrar on Election Day before close of polls.” Why is this significant? Because, as Elias explained, “ballots that are delivered to the Registrar before the close of polls are lawful ballots to be counted in Virginia,” but that “some government error” negated the ability of the voters (who “did everything right”) to have their votes counted. Elias further explained that, “in this country and under the U.S. constitution, errors by the government don’t get to be the ground to disenfranchise voters.” Elias concluded that “the rights of these [military and other] voters under the 1st and 14th amendment [are] going to prevail and these ballots will be counted.”
On the second issue, regarding the “split precincts” in Fredericksburg City, Elias explained that this “seems to have resulted in a…significant number of voters in HD-28 being denied their right to vote in the HD-28 delegate race.” Elias said “we think it affects around 650 voters, which is obviously more than the margin that currently separates the two candidates.” The problem, according to Elias, is that only one “split precinct” (between HD-28 and HD-88) is permitted in Fredericksburg under Virginia’s 2011 redistricting statute. The problem is, when you look at the unofficial results of the election [currently posted on the SBE website], it actually shows three precincts in Fredericksburg that were split between HD-28 and HD-88. The two extra split precincts are precincts that the statute says are to be entirely within HD-28. That means that ALL of the voters in those precincts should have been given ballots to vote for HD-28 and NONE of them should have been given ballots to vote in HD-88. The [SBE website] seems to suggest the opposite of that, which is that some were given for 28 and some were given for 88. Specifically, the unofficial results show 688 votes that were cast in HD-88 between the two precincts combined. Now, this is a very very serious issue, because…that is a state law, and Registrars are not free to ignore the redistricting statutes. Statutes are there to delineate who cast ballots in what districts…This is not something we have drawn a firm conclusion on, it is something we are investigating. It may be that there is a simple explanation for this…We’re being very methodical about looking at this. But if you look at the website, it appears 668 voters were denied their right to vote for the delegate who represents them by law in the 28th district. Now obviously, 668 votes is a far greater number than the number of votes that decided the election in HD-28. And if you look at the unofficial results there, based on a partisan analysis, it certainly would seem to change the outcome of the election…be race determinative…Obviously, it is not a tolerable situation for 668 voters to be disenfranchised – period – and particularly not in an election where those votes likely were race determinative of the outcome.

Gena Richardson says she was a high school senior working in the men’s department of Sears at the Gadsden Mall when a man approached her and introduced himself as Roy Moore. “He said, ‘You can just call me Roy,’ ” says Richardson, who says this first encounter happened in the fall of 1977, just before or after her 18th birthday, as Moore, then a 30-year-old local attorney, was gaining a reputation for pursuing young women at the mall in Gadsden, Ala. His overtures caused one store manager to tell new hires to “watch out for this guy,” another young woman to complain to her supervisor and Richardson to eventually hide from him when he came in Sears, the women say.
Richardson says Moore — now a candidate for U.S. Senate — asked her where she went to school, and then for her phone number, which she says she declined to give, telling him that her father, a Southern Baptist preacher, would never approve.
A few days later, she says, she was in trigonometry class at Gadsden High when she was summoned to the principal’s office over the intercom in her classroom. She had a phone call. “I said ‘Hello?’” Richardson recalls. “And the male on the other line said, ‘Gena, this is Roy Moore.’ I was like, ‘What?!’ He said, ‘What are you doing?’ I said, ‘I’m in trig class.’ ”
Richardson says Moore asked her out again on the call. A few days later, after he asked her out at Sears, she relented and agreed, feeling both nervous and flattered. They met that night at a movie theater in the mall after she got off work, a date that ended with Moore driving her to her car in a dark parking lot behind Sears and giving her what she called an unwanted, “forceful” kiss that left her scared.

The erosion of US leadership was painfully clear during Trump's Asia trip

MANILA, Philippines — During President Donald Trump’s first official Asia tour, the precipitous erosion of America’s decades-long hegemony in the region has been painfully apparent. This is partially the structural byproduct of the rapid rise of China, which has openly called for a 21st century new regional order of “Asia for Asians.” Since 2013, the Asian powerhouse has rolled out an alluring package of development initiatives, which could potentially redraw the economic landscape of the region and beyond. With China emerging as the world’s economic engine, it is proactively reclaiming its historical place in the sun.
But it is also the byproduct of the tempestuous Trump presidency’s devastating impact on American standing in Asia. Both allies and rivals in the region have been perturbed by Trump’s “America first,” neo-isolationist foreign policy. His midnight tirades on Twitter, constant attacks on the liberal international order and push to dismantle the Trans-Pacific Partnership trade agreement have collectively left America isolated even from some of its closest allies. As an official from one of America’s key partners in the region put it to me earlier this year: “Is this how superpowers commit suicide?” It appears the answer is yes.

Since Trump’s ascent to power, America’s standing in the world has experienced a virtual collapse. According to the Pew Research Center, international confidence in American leadership has declined significantly in the past year. This has been most acutely felt in the Asia-Pacific region, the new center of gravity in global geopolitics.
Among America’s Asian allies, such as South Korea and Japan, confidence in the American president’s ability to make the right judgment has dropped by as much as 71 percent and 54 percent, respectively. In Indonesia, the world’s largest Muslim nation, it dropped by 41 percent. This is nothing short of a disaster for American soft power.

The former Trump campaign foreign-policy adviser George Papadopoulos told Stephen Miller, a senior policy adviser, in an email last April that he had received an "interesting message" from Russia — one day after learning that the Kremlin apparently had "dirt" on Hillary Clinton, the 2016 Democratic presidential nominee. The emails were disclosed in court documents filed by the special counsel Robert Mueller's office and unsealed late last month. The New York Times reported on Friday that Miller was the "senior policy adviser" described, but not named, in the court filings.

The court filings say that on April 25, 2016, after "multiple conversations" with a Russian national connected to Russia's Ministry of Foreign Affairs, Papadopoulos told Miller that "the Russian government has an open invitation by Putin for Mr. Trump to meet him when he is ready," referring to Russian President Vladimir Putin. "The advantage of being in London is that these governments tend to speak a bit more openly in 'neutral' cities," he said.

Papadopoulos emailed Miller the next day. "Have some interesting messages coming in from Moscow about a trip when the time is right," he wrote, the court filings say. Papadopoulos also emailed Paul Manafort on April 27 asking "to discuss Russia's interest in hosting Mr. Trump." Manafort, who was then a campaign strategist but later became the campaign chairman, was described in the court filings as a "high-ranking campaign official." "Have been receiving a lot of calls over the last month about Putin wanting to host him and the team when the time is right," Papadopoulos told Manafort.

On May 5, Papadopoulos called Clovis. After their phone call, he forwarded Clovis the ministry contact's email with a new subject line: "Russia updates." Papadopoulos' efforts to arrange the Trump-Putin meeting continued through June. "Russia has been eager to meet Mr. Trump for quite sometime and have been reaching out to me to discuss," Papadopoulos wrote to Manafort on May 21. Manafort forwarded that email to his longtime business associate Rick Gates and said, "Let's discuss."

I worked for Bob Mueller for 12 years while he was the FBI director, running counterintelligence, espionage and cybercrime investigations. What I saw recently was a classic law-enforcement response to a suspected Russian intelligence or political-influence operation. And it was classic Bob Mueller. Already, he appears to have uncovered details of a far-reaching Russian political-influence campaign.
Russian spy services use two main methods to run agents. Either they recruit people as traditional assets, where the targets know they’re working for a foreign government. Or they use unwitting agents—people targeted to exploit not just what they know, but who they know. That’s what seems to have happened here. Russian intelligence services have run political-influence operations since the beginning of time, and if you put a seasoned intelligence officer in front of a traditional, unsuspecting businessman, there’s just no match.
The Russian goal appears to have been to use members of the Trump campaign to get at the ultimate target: Donald Trump himself. If I want to spy on Trump, I don’t need or necessarily want to get directly in front of him; I will use sources, or I will use an intermediary known as a cutout. The Russian intelligence services will then dangle something the cutout wants, whether it’s sex, money, drugs or information. In this case, it was Hillary Clinton’s emails.
To uncover just how far the Russian operation got, Mueller will focus his team. He’ll go after the lower-level or lower-ranking guys like George Papadopoulos. He’ll also use the strategy of following the money. In the next weeks and months, you’ll see more indictments. You’re going to see wire fraud. You’re going to see mail fraud. You’re going to see violations of the Foreign Agents Registration Act. You’re also going to see other charges. Moving money around countries to avoid taxes and criminal prosecution are the kinds of violations we saw continuously while I was working counterintelligence and espionage investigations.

On Friday afternoon, embattled Alabama Senate candidate Roy Moore appeared on Sean Hannity’s radio show to discuss Thursday’s Washington Post report detailing allegations that he sexually assaulted a 14-year-old and pursued sexual relationships with other teens while he was in his 30s.
Moore’s initially denied the allegations in their entirety but he was far more equivocating with Hannity. Though he denied even knowing the youngest alleged victim, then 14-year-old Leigh, Moore acknowledged that he did know two of the other victims named in the report. He denied allegations that he engaged in unlawful behavior with any of them, including one anecdote that he provided one underaged victim with wine.
When asked by Hannity if he had any recollection of dating teenage girls when he was in his mid-thirties, Moore said “it would out of my customary behavior,” but stopped short of denying that he did. At another point in the interview he said he didn’t “generally” remember pursuing girls that young. Instead, Moore seemed to validate some of the Post’s reporting, confirming, for instance, that he would seek permission from a girl’s mother before he would try to date her.

Following the interview, Moore’s campaign released another statement addressing the Post’s report. The new statement denied “providing alcohol to minors” and “sexual misconduct” but did not specifically deny pursing sexual relationships with teenagers as an adult.

Roy Moore response shows GOP deserves to die: Max Boot
This is the sorry culmination of two trends that have disfigured the conservative movement: contempt for the facts and desire to win at all costs.

You may have thought that Republicans had sunk as low as they could possibly go last year when they nominated for the presidency a man who was singularly unfit, morally and mentally, for that post. But, no, once you start racing to the bottom you never quite stop. There is always another level of degeneracy to be plumbed.
Enter Roy Moore, the Republican Senate candidate in Alabama. He believes that “homosexual conduct should be illegal” and that Muslims should not be permitted to serve in Congress. Now the Washington Post reports that this fearless crusader for “traditional values” had a habit of propositioning underage girls.

Under common morality, of the kind that Moore claims to champion, his conduct is simply vile. You don’t have to be the parent of teenage girls — which I am — to be deeply disgusted. Yet he is utterly unrepentant. Moore simply waves off the allegations, claiming, “This garbage is the very definition of fake news and intentional defamation.” On his Twitter feed he has the gall to write, “Our children and grandchildren’s futures are on the line. So rest assured — I will NEVER GIVE UP the fight!” He even has the audacity to send a fundraising appeal to his supporters claiming that the Post article is evidence that “the forces of evil are on the march in our country,” and asking for a donation to fight the “Clinton-Obama machine.”
So far, much to their eternal discredit, Moore’s Republican backers in Alabama appear to be sticking by him. Paul Reynolds, the Republican national committee man from Alabama, told The Hill that he doesn’t trust The Washington Post: “If I’ve got a choice of putting my welfare into the hands of Putin or The Washington Post, Putin wins every time.” State auditor Jim Ziegler is willing to admit the charges are true, but he doesn’t care. He cited the Biblical story of Mary and Joseph — “Mary was a teenager and Joseph was an adult carpenter. They became parents of Jesus”— and concluded, “There’s just nothing immoral or illegal here. Maybe just a little bit unusual.”
