Men Legally Allowed to Finish Sex Even If Woman Revokes Consent, NC Law States

Trump is filling the courts leaving the way open for more decisions like this.

One May evening in 1977, Beverly Hester was sexually assaulted. According to the summary included in the North Carolina Supreme Court decision State v. Way, she testified that the perpetrator, Donnie Way, threatened to beat her if she didn't have sex with him while hanging out at a friend's apartment. When she tried to leave the bedroom, he allegedly slapped her in the face.

Hester went on to tell the court that Way penetrated her anally and forced her to perform oral sex on him. She said he began having intercourse with her—though she begged him not to because she was a virgin—but stopped when she complained of severe stomach pains. Later, at the hospital, she told her mother she was raped.

Despite her testimony, the jury appeared to be swayed by the defense's argument that Hester initially agreed to have sex with Way. During deliberations, they returned to ask the judge "whether consent can be withdrawn." The judge noted that it could, especially in cases where intercourse has turned violent and thus "no longer consensual." Way was convicted of second degree rape.

The state Supreme Court, however, disagreed with the lower court's interpretation of withdrawn consent. "If the actual penetration is accomplished with the woman's consent, the accused is not guilty of rape, although he may be guilty of another crime because of his subsequent actions," the High Court wrote.


Explains some the high drama crap

I think Trump was ultimately elected by racists, sexist and assholes, but those people were enabled by bad information I guess. The thing is, it’s not that hard to find Hillary’s record of service, but the will had to be there. So many WANTED to think the worst, WANTED to spin out of control. To the point of seemingly be unable to process properly.

Anywhere you turned there was trolling. We found our “safe spaces” We Hillary supporters, as best we could. We were trolled even there. It wasn’t enough to overcome the manipulated distaste so many felt for her. Even today, the “bad candidate” meme is still out there. Trump was no secret. He never should have had a chance. Whatever Hillary’s faults, there aren’t enough for one single vote for Trump.

And here we are. I am still angry. The thing the right doesn’t understand, with all their ‘trigger a liberal” cringy nonsense, is the right is history, they need to be fought, because we are evolving past them, nobody is going back. Joy-Ann Reid had a great article on that. But there are elements of the left, who cling to the Democratic Party while constantly tearing it down, without even the moral courage to openly go third party. I can deal with third party people. I get them. I can’t deal with, or rather, am “triggered” by the enemies within.

I’m not talking about criticism or “echo chambers”. The day we stop improving and evolving is the day we die as a party, we have to be open to criticism, we can’t afford to be an echo chamber. I’m talking about the ego-driven assholes who simply use the Democratic Party to shout their shit in front, and talk their shit in back.

I believe we are seeing a changing of the guard so to speak

As whites slowly become a minority of sorts, in population, if not money and power, the edge in money and power is slowly being lost. This seems to drive some white folks crazy. It drives others who accept Whiteness as a standard crazy. We’ve never had to confront the actual repercussions of the erosion Whiteness as the dominant cultural standard. Some of us are uneasy—we were always so GOOD at cultural appropriation, we took credit where it was by no means due. We’ve done this for centuries. We’ve led the way in modern times anyway, when another culture has something interesting or attractive or genius, we created the culture of cultural theft.

And, to coin a phrase, time is up.

So much of what the right is, is reactive—anger and fear. Trump is everything diseased and damaged about Whiteness (which, so there is no mistake, does not mean white people as a whole, I know many of us are great people. I hate that I have to qualify this though, because people will misunderstand what Whiteness is, or think it merely an acedemic exercise) and about patriarchy.

Such bitter, angry, violent reactions everywhere. Trumps election even being possible . A powerful woman as a perennial scapegoat, the whole idea of libertarianism. The resurgence of the “alt-right” —a number of who started with Men’s Rights Activism fuckery. Men’s Rights Activism fuckery becoming almost mainstream—not quite, but too close. All that anger directed toward people with non-white skin and non-compliant women.

Still. Time is up.

Anti-whiteness, as it is dominant paradigm in power structures

Is not a bad thing to be. White peoples feelings get hurt over this because they tend to not examine the power structure of whiteness—that’s why all the angst and re-examining Trump voters. It’s not that BEING white is bad, it’s the blind thievery of the white and privileged—which is always on display. We just don’t look.

No. Its being sorely tested

And we are going to lose some battles. Important ones. Democracy will survive, because it is by and large very successful. It’s not perfect, and some of the imperfections led us to where we are right now, but it’s not dying. In fact, unless I miss my guess, it’s spreading across the world, Democratic principles of freedom and human rights are if nothing else becoming a seed of knowledge in those places without it.

I’m a fan of cyberpunk. It’s the one genre that can paint a fairly accurate picture of what happens when Democracy is replaced or subverted by corporate control.

This has happened, to a certain degree. But Democracy comes roaring back, because it’s an ideology that says you, the individual are also important, you have a say (vote) in what happens next. You can participate. You can be heard. You can be a change agent,

Trump is clearly not a fan Of Democracy. Republican are on a collusion course with it, but I refuse to believe that either is stronger than the idea of Democracy. Ultimately they are going to lose, and they are going to lose ugly. And it will serve them right, because while Trump may be a incurious man with limited reasoning skills, many of the The Republicans who have hitched themselves to his train—all in hopes of shrinking government— are not stupid. They are caught up in a dying patriarchal culture in the midst of an information revolution. They have no bend, and therefore will break.

Well Im not done

While I wish Franken would have let this go to investigation, perhaps there is a reason he didn’t that we don’t know. Two of the Senators calling for his resignation Patty Murray and Maria Cantwell are my senators from Washington state and I’m certainly not abandoning them. I’ve read their statements. I know their work, and I guarantee the Democratic Party needs them right where they are. If people are going to leave, I hope they do it soon.

I expected something like this to happen the moment #metoo became a hashtag. That we equivocate the moment a movement becomes challenging is to be expected. Franken took a fall in an atmophere attempting to call attention to a problem of behavior while simultaneously setting standards to behavior that has been present for millennia—not just decades. This isn’t new, this is ancient. (That’s not to say people haven’t “evolved”—they have) Franken, whatever the truth of extent of his behavior, did the right things, requested an inquiry, apologized, reisigned when his peers, many his FRIENDS asked him to. (Unless he’s playing a larger game, sacrificing himself in a very bold political move, which I wouldn’t put past him) even his resignation speech cannot be ignored for its political power.

So no, I’m not done. I do wish the resignation of Conyers brought about as much angst. But of course it didn’t

Conservative Women Keep Turning The Feminism Thing On And Off, Cant Get It To Work!

Had Bristol taken a moment to Google, she would have discovered that the entire first two pages of results on this came from Jezebel, The Daily Beast, ThinkProgress, Crooks & Liars, Media Matters, Huffington Post, NPR etc. She may have also noticed the dearth of conservative sites covering it.

(For what it is worth, Bristol — should you want to lead a campaign to get Chris Wallace fired for those comments, I would be right behind you. I would absolutely support you in any way I could, as would many other women on the Left. But why is it that we’re supposed to do all of this ourselves? Could you maybe help a little, or are you just here to stand over our shoulders and point out when we’ve missed a spot?)

Bristol Palin and Kellyanne Conway are far from alone when it comes to conservative women claiming that feminists only care when women on the left are sexually assaulted or harassed or experience sexism. Yet, if we look at the coverage of Gretchen Carlson and Megyn Kelly’s accusations against Roger Ailes, or at the accusations by a female conservative radio host against formerly beloved liberal icon Al Franken, that is demonstrably untrue. Even going back to the 2008 election, feminists who hated Sarah Palin and all she stood for were still calling out sexist bullshit against her — perhaps most notably, at the Sarah Palin Sexism Watches at both Shakesville and Feministing.

When Sarah Palin was asked about what she thought of Bill O’Reilly’s firing from Fox News, she said that the onus was on women to just “not take a paycheck” if they are being harassed.

“Corporate culture there obviously has to change. Women don’t deserve it, they should not ever have to put up with any kind of intimidating workspace. At the same time, if a woman believes she is being intimidated and harassed, she needs to stand up and do something about it, not stick around for a paycheck for years and years and years and then after the fact complain about what she went through.”

Many of them are not stupid

They are bigoted, and occasionally honestly ignorant. They have access to the same information I do.

I come from bigoted, ignorant people, and I learned. Interestingly, it was 1974, at the start of middle school when “forced busing” happened, when I was brought into contact with African American children for the first time, (and no, we didn’t become instant friends, segregation had powerful roots in our psyche’s) and the school curriculum including “black history”, when I, a voracious reader, read books on Harriet Tubman and the Underground Railroad, and Sojourer Truth, Bury My Heart at Wounded Knee, Black like Me, The Diary Of Anne Frank—-oh so many books available. And because I was NOT stupid, I processed that information in the way it was intended, got in huge fights with my parents who would make me cry on purpose by saying words like “Jigaboo”, and tell me blacks were good at sports because they ran through the jungle—saying These things when I was learning about the ancient African Dynasties and things like the Library of Alexandra—all because they were afraid I would find a black boyfriend. (The “N” word was de rigueur around my house since I could remember, except from my Swedish grandparents, who had a softer bigotry)

Those people are me. I know them. I understand them. They don’t get a pass from me because if I know better, and I hope, continue to learn better, all it takes from them is willingness. They are not willing.

What the fuck

You are assuming women have more power than we do.

I went to party—not to get laid. No matter what I wore, or how I danced. There were ALWAYS guys that wanted to obscure the line between flirting and sexual assault. Flirting is fun, and is a way to gauge response “does he/she like me? Fun, and acceptable.

My own father “grabbed my butt”—he thought it was funny when I’d get angry. What do you suggest I did back then? Oh, that’s right, I was under age. I should have called the cops, right? Boy, I fucked that up, Didn’t I. Maybe I shouldn’t have run away and hit the streets and learned entirely new set of survival skills.

You are aware that women can’t leave their drinks unattended? That’s the self protective culture that has arisen. We carry our keys in our hands walking to the door, we get escorts, we get dogs, we get security systems, we take self defense courses we get weapons. If we work in a strip clubs, there are always bouncers for protection against men. If we prostitute on the streets we are forgotten and unnamed, and the crimes against us ignored. If we are ambitious in the business world, we run into sexual pro quid pro situation for sexual favors. We are touched, brushed against, grabbed, leaned over, threatened. Assaulted

As I type this, there is a woman feeling terrified and helpless because she doesn’t know what to do. Her boss just shoved his tongue down her throat and she’s terrified of losing her job, she’s not interested in him that way. Nothing to do with clubbing and everything to do with our culture.

You know what Julian Assange is accused of? After having consensual sex with women, they awoke to find him at it again, inside them, without a condom—with no consent asked or given. And He would walk in an American court. Swedish law is quite different.

A woman alone is always in danger because she a woman alone. We are always frightened. Not the mind numbing kind of fear, the look over your shoulder kind, because a stalker or an assault is always a possibility.

I’m sick of women HAVING to be “on-guard” because hooking up in some—not all but some minds is a predator/prey situation

And then there this—a real attitude that I’ve seen here recently as yesterday to discredit the stories of women
