This isn’t the end of the fight. But if Barrett does what we all fear and uses her position to stop a fair election, Democrats are going to have to be more forceful than they were during her confirmation hearings

Democrats’ failure to persuade the public and Republicans to suspend the nomination of now Justice Amy Coney Barrett has the potential to erode American democracy for generations.

On countless questions of constitutionality, life and death, and law and order, the Court’s 6-3 majority will enforce the preferences of an extreme minority. A tyranny of the minority will fundamentally alter the American Republic, diminish the rights of the majority, and pervert any remaining equal justice under the law.

Longtime Congressional scholar Norm Ornstein has provided the best advice to the Democratic Party at this juncture: “If Amy Coney Barrett goes on the Court and immediately votes for PA voter suppression, she should quickly be impeached. Trump asked her openly to act to tilt the scales of the election.”

If Barrett does indeed rule against the rights of voters in the days leading up to or during vote-counting — refusing to recuse herself from decisions that would clearly amount to a quid pro quo for Trump’s re-election — Ornstein’s suggestion is precisely the required hardball Dems need to play to delegitimize the extremist justice and preserve democracy.

By voting against the Pennsylvania Supreme Court and interfering in state’s electoral practices, Barrett’s rank duplicity will be unmistakable — as will the fraud of her purported conviction in federalism and state’s rights.

This is when Democrats need to pounce on her ethically and legally dubious approach — to serve the interests of the Republican Party rather than uphold the law — and make the argument they were right about not seating her. Any public support for the nominee-turned-justice will crumble. And while there will not be a 2-3 majority to convict in the Senate, Pelosi and House Democrats can swiftly impeach her.

Call them the secret Biden voters.

Political observers say there is a group of voters that has emerged in this cycle: Republicans who have never supported a Democratic candidate — not for the city council, Congress or president — who suddenly find themselves set to vote for Democratic presidential nominee Joe Biden.

And they don’t want anyone to know it.


In 2016, some strategists concluded that a number of voters were secretly voting for Donald Trump but were not getting picked up by pollsters.

This year, strategists are wondering about Biden voters in red states and counties who are not waving signs and are keeping their views relatively quiet, but who could help the former vice president not only win states such as Michigan, Wisconsin and Pennsylvania, but also other states Democrats lost to Trump in 2016, such as Iowa, North Carolina and Georgia, where the vice president visited on Tuesday.

“There is a lot of evidence that they do exist and they’re everywhere,” one Biden ally said.

The Florida Republican who spoke anonymously to The Hill also feels “pushed into a corner” by Trump.

“I never ever thought I’d support a Democrat. It’s not who I am,” the Republican said. “But this was the only option.”

"If polling is accurate and former vice president Joe Biden wins handily next week, we can look forward to some very big changes: competent Cabinet officials, coherent policy initiatives, respect for the Constitution, a foreign policy that favors democracies rather than brutal dictatorships and depoliticization of the Justice Department, to name just a few.

But apart from concrete policy, we can also look forward to a host of things that we once took for granted:
White House news releases without typos, weird punctuation and other glaring errors.

Official documents that read like official documents in tone and that come out by email or hard copy, as opposed to tweets.

The absence of childish name-calling, insults, racist remarks, gaffes characterized as “jokes” and singling out of individual companies simply because they failed to boost the president’s ego.

A White House press shop that earns the presumption of trustworthiness until proven otherwise and — at worst — relies on “I don’t know” or vague evasion rather than outright lies.

News conferences in which the president does not personally insult members of the media, exclude them for writing things he does not like or dub them “the enemy of the people.”

Presidential interviews with respected news figures, not sycophantic media personalities.

A normal presidential schedule in which hours of TV time are not built in.

No more Stalinesque Cabinet meetings in which officials try to top one another in fawning over the president.

A president who communicates directly with the leaders of the House and Senate.

An administration that knows climate change is real and that more intense forest fires don’t result merely from insufficient sweeping of the forest floor.

An engaged first lady who takes up important public causes with tangible results.

An administration without relatives working in the White House.

A president who does not make money from funneling attention and revenue to his holdings.

No judicial nominee who is rated “not qualified” by the American Bar Association.

An administration in which “Infrastructure Week” is about infrastructure.

A president who can comfort the nation in times of tragedy

A president who does not use the military as props.

A president who has some basic grasp of American history, including racial injustice.

A president whose advisers are not overwhelmingly White men.

No presidential awards for political hacks, contributors and toxic media figures.

A president who never utters the phrases “red state” or “blue city.”

A White House counsel’s office that at least tries to get it right by providing advice in accord with the Constitution and statutes and polices unethical conduct.

An administration that favors easy access to voting.

Policy pronouncements issued only after consideration by relevant experts and departments.

A president who does not celebrate police brutality or excuse war crimes.

A president who does not embarrass us on the world stage.

A president who knows that there are no NATO “dues” and consumers pay for tariffs.

A president who understands the benefits of forward deployments and alliances.

A president who does not encourage Chinese detention camps or defend the human rights record of North Korean dictator Kim Jong Un."

President Donald Trump’s campaign has all but pulled its advertising out of Florida, as it stakes its relatively small bank account on the industrial northern states that carried him to victory in 2016.

Since the beginning of the fall campaign on Labor Day, Trump has cut $24 million from his national ad budget, while former Vice President Joe Biden has added $197 million. Biden has outspent Trump three-to-one over that time.

Trump is now placing his final bet on just four battleground states: Michigan, Minnesota, Ohio and Pennsylvania. Polls show he’s down in all those states but Ohio, where it’s effectively even.

The president still has $350,275 budgeted to spend on ads in Florida through Election Day, but has canceled $5.5 million in the final two weeks of the campaign, according to data compiled from ad-tracking firm Advertising Analytics.

The Trump campaign says its organizational strength in Florida will carry it into Trump’s column on Election Night as Republicans get more in-person voters to the polls.

Last night, the former reality-show personality turned the dial to 11, hosting a prime-time spectacle at the White House. It was, for all intents and purposes, a campaign celebration, held for the cameras, just eight days before Election Day.

The merriment had all the subtlety of a sledgehammer: Barrett stood in the spotlight, on a White House balcony in front of the presidential seal, alongside Trump who beamed with pride before an applauding audience, which included Republican senators who spent last week pretending they have no idea how the far-right ideologue will rule on cases of lasting import.

Barrett was then ceremonially sworn in by Justice Clarence Thomas -- arguably the high court's most reactionary conservative -- as if to drive home the point that the right had taken over the judiciary.

Barrett had a choice. She does not serve at the pleasure of the president. The Supreme Court's newest member could've told the White House, "No, I'm not comfortable with this. I'm not a trophy to be shown off during a re-election campaign." On the show last night, Sen. Chris Coons (D-Del.) described the event as "the latest episode of the Trump reality-TV show, 'Re-Election Theater.'"

And therein lies the point: Barrett's first decision as a confirmed Supreme Court justice was to agree to participate in this political spectacle. She knew about the electoral context; she knew this prime-time program would give the appearance of a political victory party; and she chose to do this anyway.


CNN's Jake Tapper heard from a Republican consultant last night who said in reference to the White House show, "If I'm [Amy Coney Barrett], I don't go to this." The consultant added that it "looks bad."

Her apparent indifference to the damage all of this does to her credibility and the legitimacy of her institution speaks volumes about Barrett and the indefensible process that concluded with such a brazenly political coda.

“President Trump bashed Fox News repeatedly on Tuesday, agitated that the network was airing a campaign speech from former President Obama,” The Hill reports.

Said Trump: “I only saw he was on Fox. And Fox puts him on all the time, and they put sleepy Joe on all the time. What they should do is they should show the picture of sleepy Joe yesterday when he rushed to Pennsylvania because he saw that I had 25,000 people at each event.”

He added: “Fox, Fox is very disappointing… This would not have happened with Roger Ailes, I can tell you that.”

A federal judge has issued a preliminary injunction to stop the Department of Housing and Urban Development from implementing a rule that would have made it harder to bring discrimination claims under the Fair Housing Act.

The rule, set to take effect Monday, would have required plaintiffs to meet a higher threshold to prove unintentional discrimination, known as disparate impact. The new rule — an update to the agency’s 2013 disparate impact rule — would also have given defendants more leeway to rebut the claims.

“These significant alterations, which run the risk of effectively neutering disparate impact liability under the Fair Housing Act, appear inadequately justified,” wrote Judge Mark Mastroianni of the U.S. District Court for the District of Massachusetts in an opinion filed Sunday.


The rule is part of a larger Trump administration effort to roll back Obama-era antidiscrimination rules. Trump this summer scrapped another Obama rule, the Affirmatively Furthering Fair Housing Act, requiring localities to track patterns of segregation or else lose federal funding.

Trump said, “Then you have Biden’s running mate. How about her? Kamala? She’s considered America’s. By far most liberal senator. She’s more liberal than Crazy. Bernie, can you believe it? Even sponsored the $100 trillion green new deal which will destroy our country. Totally destroyed. No planes, No cars, no cows, right. Cows are next, they took it out, but only temporarily. They don’t like cattle.”

Trump’s closing argument to America is that Joe Biden and Kamala Harris are secretly conspiring to ban cows. This is not true, but neither is anything else that Trump is saying at his rallies. Trump appears to be living in the past, as he openly expressed the hope that the result in Pennsylvania would be just like in 2016, but with mail-in voting surging, and over half of the ballots in the state already cast, it seems less and less likely that Trump’s barnstorming of the state will have much of an impact.

Trump is running a campaign about nothing, and he is throwing everything against the wall, and hoping that something sticks, no matter how crazy it is, because that is his only hope for winning a second term.
