RICHMOND, Va. — The federal appeals court ruled Friday the Trump administration acted in an "arbitrary and capricious" manner when it sought to end an Obama-era program that shields young immigrants from deportation.

A three-judge panel of the 4th U.S. Circuit Court of Appeals ruled 2 to 1 that the Trump administration violated federal statue when it tried to end the Deferred Action for Childhood Arrivals program without adequately explaining why. The ruling overturns a lower court ruling a judge in Maryland made last year, which Trump had previously praised via Twitter.

Friday's ruling will not have any immediate effect as other federal courts have already ordered that DACA be kept in place.

The 4th Circuit ruling said the Department of Homeland Security did not "adequately account" for how ending DACA program would affect the hundreds of thousands of young people who "structured their lives" around the program.

"This ruling is the result of a long and valiant battle that our Dreamers have endured in their struggle to keep their families together," said Lizette Olmos, a spokeswoman for Casa de Maryland, the lead plaintiff in the case.

Trump and his Justice Department have argued that the Obama administration acted unlawfully when it implemented DACA. The Justice Department did not immediately return a request for comment.

Preserving DACA is a top Democratic priority, but discussions between Trump and Democrats on the issue have gone nowhere.

White House deputy press secretary Hogan Gidley downplayed reports Friday that the Trump administration was considering invoking the Insurrection Act to remove immigrants from the country — but he didn’t rule out that it was still on the table.

“There are lots of tools at [President Donald Trump’s] disposal,” Gidley said, speaking with Fox & Friends. “We haven’t used them all and we’re looking at ways to protect the American people.”

Gidley’s comments were received warmly by the live studio audience which applauded enthusiastically about the idea of using the military to force out undocumented immigrants at gunpoint.

“That would be great,” host Brian Kilmeade responded. “Last time we used [the Insurrection Act], I believe, was the L.A. riots where the military came in and said we are going to need military presence there. The military is there [at the border] but they can’t do as much as they want.”

Sixty-three people were killed and 2,383 were injured in the 1992 Los Angeles riots Kilmeade referenced Friday, after police and military forces were deployed to snuff out riots and protests against the acquittal of several police officers involved in the brutal beating of a black man, Rodney King, whose arrest one year earlier was captured on video.

Gidley’s comments come one day after Trump announced his new immigration plan, and hours after conservative outlet The Daily Caller reported that Trump plans to invoke the Insurrection Act to remove undocumented immigrants from the country using military force. The report cited “multiple senior administration officials” who said the White House was “doing the Insurrection Act.”

Under the Insurrection Act of 1807, the president has the authority to use military force within the country’s borders, but only in the very specific instances of “insurrection, domestic violence, unlawful combination, or conspiracy.” It can also be invoked in disaster scenarios, but only if there is such widespread domestic violence that local authorities cannot maintain public order.

The presence of undocumented immigrants in the country in no way meets these qualifications. One of the officials who spoke to The Daily Caller seemed to recognize that Trump would surely face legal challenges if he actually tried to invoke the act, but they were also optimistic that the Supreme Court would side with Trump as it did in upholding his Muslim travel ban.

CHICAGO — Democratic presidential contender Pete Buttigieg on Friday accused Vice President Mike Pence of advancing “homophobic policies,” saying that while he doesn’t know whether Pence is truly homophobic, his policies are “hurting other people” just the same.

“I don’t know what’s in his heart,” Buttigieg told conservative radio host Hugh Hewitt in an interview airing Friday. But, he added, “if you’re in public office and you advance homophobic policies, on some level it doesn’t matter whether you do that out of political calculation or whether you do it out of sincere belief.”

“The problem is, it’s hurting other people,” said Buttigieg, the South Bend, Indiana, mayor.

Buttigieg’s comments may add further fuel to an emotional dispute that’s played out between him and Pence, the former Indiana governor, over LGBT issues. Buttigieg, who is openly gay and married to a man, has invoked Pence’s name on the campaign trail to say that if Pence has a problem with his sexuality, his problem “is with my creator.” That led Pence to accuse Buttigieg of leveling “attacks on my Christian faith.”

Democrats Demand Investigation Into Mitch McConnell’s Russia Payoff

Democratic lawmakers Reps. Maxine Waters and Adam Schiff along with Sens. Sherrod Brown and Ron Wyden are calling for an investigation into Mitch McConnell’s Russia bribe.

The lawmakers wrote, “Given that EN+ is a company substantially owned by individuals and entities with close ties to the Russian government, we believe the proposed transaction warrants immediate review by the Committee on Foreign Investment in the United States.”

As I wrote when McConnell got his Putin payoff, “This is one of the easier forms of Russia/Republican corruption that one will ever see. McConnell enabled the Russian attack on US democracy in 2016 by refusing to stand with Obama in denouncing Russian efforts to manipulate the presidential election.

It is not a coincidence that the least popular senator in America used his power as Senate Majority Leader to stop Democrats from reimposing sanctions on a Russian oligarch and then that same oligarch just so happens to invest $200 million in McConnell’s home state before the reviled senator is running for reelection.

Those are some unbelievable coincidences, and why Democrats are demanding an investigation into the investment in Kentucky.

Mike Flynn told Mueller that members of Congress tried to obstruct the Russia investigation for Trump, and the red investment in the Bluegrass state shows that the national security threat is inside the Republican Party.

Rachel Maddow only had one question following the explosive news that former Trump national security adviser Michael Flynn told investigators that people connected to the White House and Congress reached out to him as a way to obstruct the Russia investigation.

“How is the president not being impeached for obstruction of justice right now?” an exasperated MSNBC host asked on Thursday.

Maddow said the interactions that Flynn had with people in Trump’s orbit to interfere with the Russia probe were “like the stuff that gets cut out of a B-movie because it’s a little too ham-handed in terms of explaining to the audience how this particular crime family does its business.”


Rachel Maddow said:

Just a little personal aside here: How is the president not being impeached for obstruction of justice right now? I mean, that episode alone — I realize there’s a lot of equities involved in terms of whether or not the president is going to be impeached for stuff like this, but this is the president’s personal counsel calling up Flynn and being like, ‘You know, it might be a national security issue if you said anything about the president. You know how much the president likes you, wouldn’t want me to tell him you turned hostile on him, would you? I’m going to go ahead and tell him. I’m going to tell him you’ve become hostile to him if you go ahead and cooperate, you sure you want to cooperate?’ This is like the stuff that gets cut out of a B-movie because it’s a little too ham-handed in terms of explaining to the audience how this particular crime family does its business. A National Farmers Union executive and active Wisconsin dairy farmer joined Midwest agricultural leaders this week in condemning President Donald Trump's ongoing trade war with China, warning of increased financial stress and suicide among farmers.

Patty Edelburg, vice president of the Washington-based NFU group, which says it represents some 200,000 U.S. farms, appeared on Fox News Thursday and detailed what she viewed as the dire state of American farming amid falling income and commodity prices, resulting in a surging number of bankruptcies, increased financial stress and suicide in the agricultural community.

“It has been insane,” Edelburg told America's Newsroom anchors Sandra Smith and Jon Scott Thursday. “We’ve had a lot of farmers—a lot more bankruptcies going on, a lot more farmer suicides. These things are highlighting many of the news stories in our local news."

Recent national data and surveys show rural mental health problems are rampant and rising among U.S. farmworkers.

CNN reports that his income includes $40.8 million from his Trump International Hotel in Washington, D.C., and $22.7 million from his Mar-a-Lago resort in Florida. Overall, the president’s income appears to have risen from the year prior—when he reported a total income of at least $450 million. Since taking office, Trump has maintained his interest in his namesake company, the Trump Organization, but passed along its day-to-day management to his two sons.

“The barrier that President Trump wants to build along the Mexico border will be a steel bollard fence, not a concrete wall as he long promised, and the president is fine with that. He has a few other things he would like to change, though,” the Washington Post reports.

“The bollards or ‘slats,’ as he prefers to call them, should be painted ‘flat black,’ a dark hue that would absorb heat in the summer, making the metal too hot for climbers to scale.”

“And the tips of the bollards should be pointed, not round, the president insists, describing in graphic terms the potential injuries that border-crossers might receive.”

The second sentence of the Mueller report states clearly that “the Russian government interfered in the 2016 presidential election in sweeping and systematic fashion.” The Senate, however, doesn’t plan to do anything about it.

According to Sen. Roy Blunt (R-MO), election security legislation is not on the agenda. “At this point I don’t see any likelihood that those bills would get to the floor if we mark them up,” Blunt said in a Senate Rules Committee meeting Wednesday. “I think the majority leader is of the view that this debate reaches no conclusion. And frankly, I think the extreme nature of H.R. 1 from the House makes it even less likely we are going to have that debate.”

H.R. 1, known as the “For the People Act,” is a massive election reform bill that House Democrats passed earlier this year. Republican lawmakers and their conservative supporters have opposed the legislation, in part because it would add a lot of transparency to campaign funding, and in part because its crackdowns on voter suppression and partisan gerrymandering would dismantle the unfair advantages Republicans hold in many parts of the country.

Senate Majority Leader Mitch McConnell (R-KY) has insisted that he won’t even allow a vote on the bill in the Senate, describing it as a “radical, half-baked socialist proposal.” But McConnell isn’t allowing votes on any legislation. As ThinkProgress recently reported, the Senate has not considered any matters whatsoever in recent months aside from confirming President Donald Trump’s judicial nominees.

The head of Chick-fil-A’s tax-exempt foundation addressed the growing backlash against its continued giving to anti-LGBTQ organizations on Wednesday, telling Business Insider that it does not intend to change its ways. He dismissed concerns about the Chick-fil-A Foundation giving millions to organizations that discriminate as an unimportant “political or cultural war that’s being waged.”

ThinkProgress reported in March that the Chick-fil-A Foundation distributed $1.8 million in 2017 to non-profits with a history of anti-LGBTQ discrimination — contrary to repeated promises that it was winding down its giving to groups that discriminate. This included more than $1.6 million in contributions to the Fellowship of Christian Athletes, a religious group that works to spread an anti-LGBTQ message to college athletes, requiring a strict “sexual purity” policy for its employees that bars any “homosexual acts.”

In the weeks since the report, the company has faced a backlash. At least two airports have canceled plans to include a Chick-fil-A location in their vending agreements, and higher education students and faculty have pushed to remove Chick-fil-A from their campuses. The city council in San Jose, California, voted 11 to 0 last month to hang rainbow flags and blue-and-white transgender rights flags near the company’s location in the San Jose International Airport.

But Rodney Bullard, Chick-fil-A’s vice president of corporate social responsibility and the executive director of the Chick-fil-A Foundation, isn’t backing down. In an interview with Business Insider, he suggested that because the donations were aimed at helping children, it does not matter whether the recipients are practicing or promoting discrimination.

“The calling for us is to ensure that we are relevant and impactful in the community, and that we’re helping children and that we’re helping them to be everything that they can be,” he told the outlet.

“For us, that’s a much higher calling than any political or cultural war that’s being waged. This is really about an authentic problem that is on the ground, that is present and ever present in the lives of many children who can’t help themselves,” he continued.
