GREG GUTFELD: It boils down to a simple fact that almost anybody can understand: There's no logic in having no last resort, because when all else fails, then what do you do? Do you just go to lunch? Go, well, yeah, we talked to this guy, and he's not telling us anything, so I guess we're done. No, you go digital. You know, you cut off the fingers and toes. You always have to have a last resort -

KIMBERLY GUILFOYLE: That was so Jack Bauer.

GUTFELD: -- because it's not right. You're not doing your job if you don't have that one last thing you're willing to do.

ERIC BOLLING: So torture, as Dick Cheney points out, is also having to make the decision to jump to your death on the 85th floor or burn to death from there -- one or the other, you're never going to see your family again. That was the real definition of torture, not the enhanced interrogation methods.

BECKEL: How about all the information Dick Cheney had showing that that was going to happen?

BOLLING: Allow me to finish this, Bob. I haven't said a word. Here's where we are right now: We're back to September 12th, 2001, where the day after the towers came down, everyone was on their toes. They were vigilant. They see something, say something, call a cop. And the cops went after, they asked someone taking a picture of a building, "What are you doing? I'm going to confiscate that camera. We're going to see what you're doing."

We're back to that, because that's the only way we're going to get safe now instead of the PC crap that's going on, with CAIR saying, "Don't listen to our mosques. You don't have a right to." Really? I think you have probable cause now, especially with what's going on with ISIS saying every wannabe jihadist in America or around the world, in the name of ISIS, is getting in and kill somebody, kill somebody for the hell of it, you can do it alone, you can be a lone wolf. So now is the time we have to go back and embolden and empower our intel community to go and do these things, instead of, ooh, let's not offend Muslims right now.

GUILFOYLE: Oh and don't offend Iran or China either, because they're not happy with us.

BECKEL: Excuse me, I'm the last one to be accused of that, number one. And number two, why don't you take some ISIS prisoners -- we've got some. Let's waterboard them.

Referred to only as “Witness 40” in grand jury material, the woman concocted a story that is now baked into the narrative of the Ferguson grand jury, a panel before which she had no business appearing.

While the “hands-up” account of Dorian Johnson is often cited by those who demanded Wilson’s indictment, “Witness 40”’s testimony about seeing Brown batter Wilson and then rush the cop like a defensive end has repeatedly been pointed to by Wilson supporters as directly corroborative of the officer’s version of the August 9 confrontation. The “Witness 40” testimony, as Fox News sees it, is proof that the 18-year-old Brown’s killing was justified, and that the Ferguson grand jury got it right.

However, unlike Johnson, “Witness 40”--a 45-year-old St. Louis resident named Sandra McElroy--was nowhere near Canfield Drive on the Saturday afternoon Brown was shot to death.

WHO WOULD JESUS TORTURE?

In short, the same people who lied to us about weapons of mass destruction are now lying to us in the aftermath of their criminal abuses of detainees. It's as if they've not heard that we know they lied to us to get us into the war in the first place. It's as if they've decided the best course of action is to stick to the party line, goosestep along with a unified denial of proven facts, and hope their asses don't end up in front of war crimes tribunal at the Hague.

And that's exactly what should happen next.

If there were any justice in this nation, we would insist that those responsible for taking us down this immoral rabbit hole be held accountable before an international tribunal. We would insist on nothing less if it had been our sons or daughters being waterboarded, or if our own soldiers were sexually, physically, and psychologically abused while in the captivity of another nation's security forces. We can't indignantly point out the inhumane crimes of others and insist upon international condemnation of those acts if we're not going to come clean and punish those who committed criminal abuses in our names.

We owe it to the world and to our nation's honor to offer up the war criminals we're currently shielding from international prosecution.

In the meantime, it would be helpful if the people who sanctioned, ordered, and carried out these crimes stopped invoking the name of Christ whenever they want to point to our superior moral authority around the world. We should either stop using the guy's name, or start living up to His teachings.

In the long term, it makes way more sense to buy a good toaster. But if the good toaster is 30 bucks right now, and the crappiest toaster of them all is 10, it doesn’t matter how many times I have to replace it. Ten bucks it is, because I don’t have any extra tens.

Now the Blackout Collective has shut down the West Oakland BART with a human chain - in support of Mike Brown and in memory of Oscar Grant (who was executed on a BART platform by BART police) and all the others who have been gunned by down by police,

The West Oakland Bart is a choke point for the system, as all trains passing from the East Bay to San Francisco and vice versa must pass through it, before or after they enter the BART tunnel crossing the Bay.

After Cheney, Who is next? Charles Manson?

Why are torturers being given “balance” in the press?

Why? Who's next? Charles Manson?

This stuff is obvious. And yet the TV shows and newspaper stories are full of balance given to the pro-torture side. Why? Despite objections to the contrary, journalists do not always give balance to both sides of an argument if the other side is deemed irrelevant or depraved. Whenever the deficit bugbear rolls to the forefront, almost no balance is given to the Keynesian point of view despite their predictions being consistently correct: the idea that one needn’t actually cut the deficit during a recession is treated as so outre as to require no journalistic attention.

More pointedly, when journalists write about torture and depredations of current or former regimes, journalists don’t feel the need to get the torturers’ side of the story. No one is rushing to ask Assad’s torturers in Syria if their tactics are necessary to keep “terrorists” in check. No one is asking North Korean guards if their treatment of their people is OK because some other country is worse. No one rushes to counterbalance the accounts of Holocaust victims with the justifications of Nazi guards. It simply isn’t done, any more than we “balance” stories of child sexual abuse with a hot-take counterpoint from a member of NAMBLA. The reason we don’t provide “balance” in these cases is that to do so would be to normalize those behaviors as part of legitimate discourse.

So why in the world are the torturers who subjected innocent people to anal feedings and dungeon ceiling hangings given the courtesy of “balance” in the press? Where is the line that separates issues that require balance from those that do not?

"It gave us actionable intelligence" wouldn't be a defense even if it were true: this is the key to the argument. Even if it had produced information that was useful in any capacity other than advancing the GWoT and producing effective propaganda for continuing the fight, it isn't acceptable because the methods are not those a nation of laws is supposed to employ. The US cannot denounce use of these methods elsewhere and justify employing them for its own purposes; if they are not acceptable to be used on US citizens/servicepeople then they are not acceptable to be used by the same. Period. The potential for producing "actionable intelligence" is not even relevant.

.....as everybody knows by now, it was my man Chuck Todd, caretaker of the Overlook Hotel of American journalism, who came face to face with the cowardice and evil of Dick Cheney, twice-elected vice-president of the United States. It is not my man Chuck Todd's fault that he came out the worse for wear. (Although I could have done without the reappearance of Dan Senor, the former spokesman for the criminal conspiracy in question, and a minor-league barbarian who added nothing to the discussion.) Cheney's cowardice and evil are implacable forces of nature. This is a guy who had other priorities, and took five deferments rather than go to an actual war. This is a guy who shot his best friend in the face, and who went for the Scotch bottle before he went for the cops. This is a guy who projected his own cowardice onto the country he served, assuming it was as big a coward as he has been his entire public life, and sent his country down the road into serious war crimes because he got scared witless on September 11, 2001. I have more respect for a janitor who went back to work in the Empire State Building on September 12 of that year than I do for the entire sorry public career of this obvious beast of human, running now on a borrowed heart without the inconvenient presence of a soul. This is the statement that has given elderly wingnuts their semi-annual erections this morning.

To draw some kind of moral equivalent between waterboarding judged by our Justice Department not to be torture and what the Japanese did with the Bataan Death March and the slaughter of thousands of Americans, with the rape of Nanking and all of the other crimes they committed, that's an outrage. It's a really cheap shot, Chuck, to even try to draw a parallel between the Japanese who were prosecuted for war crimes after World War II and what we did with waterboarding three individuals--

CHUCK TODD: I understand.

You do? I don't. In 1901, an American soldier was sentenced to 10 years hard labor for waterboarding a single Filipino prisoner.

CHENEY: Well, torture, to me, Chuck, is an American citizen on a cell phone making a last call to his four young daughters shortly before he burns to death in the upper levels of the Trade Center in New York City on 9/11. There's this notion that somehow there's moral equivalence between what the terrorists and what we do. And that's absolutely not true. We were very careful to stop short of torture. The Senate has seen fit to label their report torture. But we worked hard to stay short of that definition.


Of course, it was the negligence and dereliction of duty of the administration, and the feckless boob who headed it, that led to that poignant phone call far more than did the actions of some farmer who got sold by his neighbors into the fevered night sweats of Dick Cheney's cowardice. I am completely opposed to capital punishment in all cases, and also to the brutality described in the Senate report. But if this cowardly barbarian were to fall victim to the horrors he inflicted on other people in our name, I would not lose a moment's sleep, or invest a moment's sympathy.
