Leading US PPE Manufacturer Still Fighting Against Verdict Obtained By Michael Avenatti

(Reuters) - In 2017, before he became a household name, Michael Avenatti won a jury verdict of nearly a half-billion dollars for a class of California medical centers. Avenatti, at the time a name partner of Eagan Avenatti, was the court-appointed lead counsel for the class, which claimed Kimberly-Clark and Halyard Health were fraudulently marketing surgical gowns that failed to block communicable diseases.In 2017, before he became a household name, Michael Avenatti won a jury verdict of nearly a half-billion dollars for a class of California medical centers. Avenatti, at the time a name partner of Eagan Avenatti, was the court-appointed lead counsel for the class, which claimed Kimberly-Clark and Halyard Health were fraudulently marketing surgical gowns that failed to block communicable diseases.

The defendants, which have always denied the class allegations, persuaded U.S. District Judge Dolly Gee of Los Angeles to slash the verdict to about $26 million. That judgment is now on appeal, by both the class and the defendants, at the 9th U.S. Circuit Court of Appeals.

And we’re missing a very important aggregate number indeed: a control group. How would a comparable group of patients have performed in these RNA tests for contagiousness under another standard of care? Even with or without azithromycin, if you can’t stand the thought of not giving them hydroxychloroquine? We don’t know. Without matched controls, and without being able to look at individual patient data, we just don’t know how good this treatment was or frankly if it was any good at all. We may be seeing a notable effect size in what is still a small trial, or we may be seeing something that’s not that remarkable or the result of a poorly controlled protocol.
