Much of the problem lies in the adherence to a written, static constitution that is not permitted to evolve (save and except for an amending mechanism that is almost impossible to work with). As a result, matters are locked in a manner that may have been right in 1776, but don't look so great in hindsight. Most notably, the electoral college system may have made sense when there were 13 colonies of more equal population, but now there are 50, many with low population, carrying disproportionate power.

Also, as the country becomes more urbanized, the "winner takes all" system within each state seems off--New York City carries New York State (good luck to a Republican there), and urban dwellers in Texas similarly are not heard. No one imagined, in 1776, a great urban migration and the differing views of its urban citizenry.

There are a myriad of other things that warrant revisiting, but cannot be, due to this rigidity. For instance, why are voting hours and requirements, down to the number of polling stations, so varied by state?

This all results in unfairness, a feeling of not being represented, and polarity of two ruling parties which no one imagined in 1776 would result.

There are still seven states left undecided in the presidential race. Hereís where they stand on Wednesday morning.

Wisconsin. Joe Biden leads by about 20,000 votes or by seven-tenths of a percentage point (which is almost exactly the margin of President Trumpís victory here in 2016). That might not seem like a daunting deficit, but thereís just not much reason for hope for Mr. Trump. Only a scattering of precincts remain across the state. This race might still be considered too close to call as long as there are still outstanding votes, but you can pencil this one into the Biden column if youíre gaming out whatís likely to happen from here.

Nevada. Mr. Biden has only a narrow lead, but here again itís hard to see where Mr. Trump is supposed to make up ground. All of the Election Day vote has been counted, and now only Democratic-leaning late mail and provisional ballots remain. Nevada election officials said no more results would be released until noon Eastern on Thursday.

Arizona. The president is at a much larger five-point deficit in Arizona, so you might be surprised to learn that itís still up for grabs. But thereís uncertainty about the remaining vote. One thing we know: There are late mail ballots, received by the state over the last few days. These ballots usually tilt Democratic, but this year they might not. So many Democrats rushed their ballots in early that most of the remaining absentee ballots are from registered Republicans. Itís possible these Republicans just went out and voted on Election Day. But itís also possible theyíve sent in their ballots, which havenít been counted yet. Weíll get a better idea later Wednesday, when officials have said they expect to have finished counting ballots.
