Encouraging Senate comment from Dave Wasserman

From Cook Political Report, on Twitter this morning:

"After last night's NV mail ballot trend, excellent chance now that Dems will have 50 Senate seats/control in hand heading into the GA runoff."


Having 50 seats BEFORE the runoff means control of the Senate is NOT riding on that one runoff election, which should make it easier for us to win. If Senate control hinges on that runoff you know Rethugs will throw everything they have at it, & they fight dirty.

I hope Dave is right!

I just early voted in Florida, turnout was HUGE.


I always early vote in person because I don't trust mail-in voting here, too many mail ballots are rejected because the signature "doesn't match," which is a subjective judgement, not a scientific one.

I'd say turnout today was about 3x what I normally see in any election, even a presidential election. I hope that's a good sign.

For reference in my area in 2020 41% voted Biden & 57% voted Trump, we'll see what happens this time.

Liz Cheney justified an extraordinary subpoena to a former President by saying that “more than 30 witnesses in our investigation have invoked their Fifth Amendment right against self-incrimination.” They include John Eastman, who told Mr. Trump that Vice President Mike Pence could derail the Electoral College count, as well as Jeffrey Clark, who tried to get the Justice Department to legitimize dubious fraud claims.

White House Chief of Staff Mark Meadows has refused to testify. Outside adviser Steve Bannon also refused and was convicted of contempt of Congress, for which he’ll soon be sentenced.

What the committee has accomplished, however, is to cement the facts surrounding Mr. Trump’s recklessness after Nov. 3 and his dereliction of duty on Jan. 6. The Justice Department and Mr. Trump’s own campaign repeatedly told him that his fraud claims were without basis. Whether it was willful blindness or an intentional strategy, he kept repeating them.

In testimony played Thursday, former White House Communications Director Alyssa Farah Griffin said that about a week after Joe Biden was declared the winner, “I popped into the Oval just to, like, give the President the headlines and see how he was doing, and he was looking at the TV, and he said, ‘Can you believe I lost to this effing guy?’” Yet Mr. Trump still pressured Mr. Pence to stop the Electoral College count, while calling for a Jan. 6 rally that he tweeted “will be wild!”

Fourteen-year-old girl denied life-saving prescription refill under Arizona abortion law

A teenager in Arizona’s Tucson city was refused a refill of a life-saving prescription drug within 48 hours of Arizona abolishing abortions under its new law, according to her doctor.

The 14-year-old girl, a patient with debilitating rheumatoid arthritis and osteoporosis, had been prescribed the immunosuppressant methotrexate to fight the pain and symptoms of her disease.

But she was refused a refill of the drug after Arizona rolled out its new law against abortions on 24 September, on the basis that the drug can also be used to end ectopic pregnancies.

Hey, everyone hyperventilating about #EmptyFolders—

Slow down. Breathe.

Yes, the inventory lists empty folders with “CLASSIFIED” banners or marked "Return to Staff Secretary/Military Aide.”

This almost certainly doesn’t mean what you think.

Here’s a sanity check.

Classified documents, and most unclassified docs that are nevertheless sensitive, are usually carried between offices in places like the White House *in folders*.

Why? In large part, to keep prying eyes (or enterprising press photographers) from seeing them during transit.

So it is natural that boxes containing hundreds of classified/sensitive documents would also have the very folders that the docs had once been carried in and left in on a principal’s desk.

You need not list which folder each doc was in, if was in a folder at all when found.

But whether the docs were in these folders or not, the agents needed to document that there were in fact folders in there. Those are physical objects, and the agents there did need to account for ALL of the physical objects they’d found.

The haphazard intermingling of classified and presumably unclassified papers (and other things) in these boxes suggests that the folders sometimes would be in the same boxes as the documents they once contained, and sometimes not.

Is it possible that the presence of empty folders—even if they were empty when found, which isn’t clear—reflects that there are additional documents that have not yet been found?

Possibly, sure. But not necessarily. And, I would argue, more unlikely than likely.

So the wife & I both have COVID

We started feeling bad yesterday & tested positive.

I had the original strain back before I was eligible for a vaccine & that was bad, I didn't need hospitalization but it wiped me out for 4 months.

This strain isn't nearly as bad so far, more like a cold or flu.

Of course, this is after having the original COVID pre-vaccine, then 2 vaccines, plus a booster.

With one simple sentence, Congress could (mostly) end the “independent state legislature doctrine”

The Elections Clause provides, “The times, places and manner of holding elections for Senators and Representatives, shall be prescribed in each state by the legislature thereof; but the Congress may at any time by law make or alter such regulations, except as to the places of choosing Senators.”

Here, the (hypothetical) Symmetrical Elections Act of 2022:

Except where otherwise inconsistent with the Constitution of the United States or with Federal law, the times, places, and manner of holding elections for Senators and Representatives shall be the same as for the most numerous branch of the state legislature, including the times, places, and manner set forth in the Constitution, laws, and regulations of the state, as authoritatively interpreted by the courts of the state
