In affirming a breaking-and-entering conviction in a 2013 Las Cruces case, the New Mexico Supreme Court has ruled that window screens provide protection from intruders and that placing one’s fingers behind a screen is an intrusion.
The state’s highest court on Feb. 25 affirmed the conviction of Anthony Holt, who was found guilty on one count of breaking-and-entering, a fourth-degree felony, by a Doña Ana County jury after a trial in 3rd Judicial District Court in Las Cruces.
Holt was accused of partially removing a window screen from a Las Cruces resident’s home on Dec. 19, 2010, according to court documents. While removing the screen, he placed his fingers behind the screen and “inside an outer boundary of the home.” But he “promptly” fled after being detected by the homeowner.
He was arrested and later indicted by a grand jury on one charge of breaking-and-entering. At trial, his defense sought a directive verdict, arguing that no entry had occurred because he was “interrupted” by the homeowner and “never did get inside” the home, court documents say. But he was found guilty and sentenced to five years and six months in prison.

Superdelegates Exist to Protect Party Leaders from Grassroots Competition - DWS
Democratic National Committee chair and Florida Congresswoman Debbie Wasserman Schultz explained the motive behind the Democratic Party’s appointment of unpledged delegates, also called “superdelegates,” who are former party leaders and elected officials who are allowed to ignore the outcome of primary elections’ popular vote totals and instead vote for the presidential candidate of their personal choice at the party’s nominating convention.
CNN’s Jake Tapper asked Wasserman Schultz on Thursday, “Hillary Clinton lost to Bernie Sanders in New Hampshire by 22 percentage points, the biggest victory in a contested Democratic primary there since John F. Kennedy, but it looks as though Clinton and Sanders are leaving the Granite State with the same number of delegates in their pockets because Clinton has the support of New Hampshire’s superdelegates, these party insiders. What do you tell voters who are new to the process who says[sic] this makes them feel like it’s all rigged?”
Wasserman Schultz replied, “Well, let me just make sure that I can clarify exactly what was available during the primaries in Iowa and in New Hampshire. The unpledged delegates are a separate category. The only thing available on the ballot in a primary and a caucus is the pledged delegates— those that are tied to the candidate that they are pledged to support, and they receive a proportional number of delegates going into our convention.”
She added, “Unpledged delegates exist really to make sure that party leaders and elected officials don’t have to be in a position where they are running against grassroots activists. We are as a Democratic Party really highlight and emphasize inclusiveness and diversity at our convention, and so we want to give every opportunity to grassroots activists and diverse, committed Democrats to be able to participate, attend, and be a delegate at the convention. And so we separate out those unpledged delegates to make sure that there isn’t competition between them.”

One of my pet interests is appropriate separation of church and state... particularly regarding public schools.
I regularly read stories of teachers, coaches, and school administrators preaching the 'good word' on school time to a captive audience.
Often, an organization like the Freedom From Religion Foundation will take up the case and write a letter and if the activity isn't stopped then a court case can go forward.
At what point is something, not even this specific issue, considered to have a legal foundation and bringing someone in a X vs Y court case in unnecessary?
IOW, at what point can someone make a call to the authorities and report that a law is being broken and it is on the government to investigate and prosecute as opposed to a private organization bringing the school etc.. to court?
"I've been robbed" " My civil rights were violated" etc.. etc..
Or is it always necessary?
I believe that I understand that the issues can be re-adjudicated at state levels based on state laws but what about a federal mandate such as the establishment clause?
Clear as mud I hope... I feel like this is a basic concept but I must have missed that specific day of civics...
Florida musician killed by plainclothes cop never fired gun: lawyer
PALM BEACH GARDENS, Fla. (Reuters) - A Florida musician who was shot and killed by a plainclothes police officer after his car broke down on a highway exit ramp never fired the handgun he was carrying and was running away at one point, lawyers for the dead man's family said on Thursday.
Corey Jones, a 31-year-old black drummer, was waiting for a tow truck around 3 a.m. on Sunday when he was approached by Nouman Raja, who was driving an unmarked van, the lawyers told a news conference on the steps of the Palm Beach County courthouse.
Police say there was a confrontation with Jones, who was carrying a recently purchased handgun, that ended with Jones being shot and killed by Raja, who was on duty investigating a burglary.
The shooting is the latest in a string of fatal incidents involving police and black men across the United States that have sparked outrage and fueled questions about excessive use of force by officers.
